SUBJECT: FIRST READING OF AN ORDINANCE AMENDING CHAPTER IV (SENIOR
COMMISSION) OF THE COSTA MESA MUNICIPAL CODE INCREASING THE NUMBER
OF MEMBERS OF THE SENIOR COMMISSION

RECOMMENDATION:
Staff recommends that the City Council read by title only, waive further reading and
introduce Ordinance No. 15-02 (Attachment 1) increasing the number of senior
commissioners from five (5) to seven (7).
BACKGROUND:
At the October 21, 2014 City Council meeting the City Council established a senior
commission which includes five (5) members. At the January 20, 2015 City Council
meeting five (5) commissioners were selected. Three (3) residents were selected for four
(4) year terms. Those residents are: Kirk Bauermeister, Stella Adkins, and Janet Lee
Krochman. Further, two (2) residents were selected for two (2) year terms. Those
residents are: Ernie Feeney and John McGlinn.
At the January 20, 2015 City Council Meeting, the City Council asked staff to bring back
an ordinance to increase the number of commissioners serving on the Senior
Commission.
ANALYSIS
Although the Senior Commission will work well with five (5) members, adding two (2)
additional members will offer a more diverse commission and will provide a broader group
of individuals to act as liaisons to various committees. Staff is recommending not to
exceed seven (7) commissioners. Any more than seven (7) members will cause issues
with a quorum and it will become more challenging in terms of effective decision making.
ALTERNATIVES CONSIDERED:
1. City Council may choose to change the number of commission members to nine (9).
2. City Council may choose to change or add language to the proposed ordinance.
FISCAL REVIEW:
The cost to add two additional commissioners to the Senior Commission annually is
$1,200.00. This cost will be absorbed in the current Parks and Community Services
Department Budget.
LEGAL REVIEW:
The City Attorney's Office has reviewed the agenda report and prepared the attached
proposed Ordinance.
CONCLUSION:
Staff recommends that the City Council approve the additional two (2) members to the
Senior Commission through the adoption of the attached ordinance.

ORDINANCE NO. 15-02
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, AMENDING SECTION 12.84 OF CHAPTER IV OF TITLE 12 OF THE
COSTA MESA MUNICIPAL CODE REVISING THE SENIOR COMMISSION TO ADD
TWO ADDITIONAL COMMISSIONERS FOR A TOTAL OF SEVEN.
WHEREAS, the City of Costa Mesa is committed to serve the needs of its senior
population through the provision of programs and service at the Costa Mesa Senior
Center; and
WHEREAS, the City Council of the City of Costa Mesa desires to establish a
Commission to study and advise the City Council on matters affecting the senior
community in the City of Costa Mesa.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Section 12.84 (Membership) of Chapter IV (Senior Commission) of
Title 12 (Parks and Recreation) of the Costa Mesa Municipal code is hereby amended as
follows:
Sec. 12.84. Membership.
The senior commission shall consist of seven (7) members appointed by a
majority vote of the entire city council. The city council may, by majority vote,
remove any member of the senior commission. Additional details for the
appointment procedures and member qualifications, terms, and compensation
may be set by city council policy.
Section 2. Any provision of the Costa Mesa Municipal Code or appendices
thereto inconsistent with the provisions of this Ordinance, to the extent of such
inconsistencies and no further, is hereby repealed or modified to that extent necessary to
effect the provisions of this Ordinance.
Section 3. If any section, subsection, sentence, clause, phrase or portion of this
ordinance is for any reason held to be invalid or unconstitutional by the decision of any
court of competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this Ordinance. The City Council of the City of Costa Mesa hereby declares
that it would have adopted this Ordinance and each section, subsection, sentence,
clause, phrase, or portion thereof, irrespective of the fact that any one or more sections,
subsections, sentences, clauses, phrases or portions be declared invalid or
unconstitutional.
Section 4. The Mayor shall sign and the City Clerk shall certify to the passage
and adoption of this Ordinance and shall cause the same to be published and posted
pursuant to the provisions of law in that regard and this Ordinance shall take effect 30
days after its final passage.
