RECOMMENDATION:
Provide direction regarding the draft ordinance for a city -sponsored proposal to establish
regulation of medical marijuana businesses.
BACKGROUND:
At the November 18, 2014 City Council meeting, staff presented two ballot initiatives that
had qualified for placement on the local ballot regarding medical marijuana. Pursuant to
Elections Code Section 9212, the City Council directed staff to generate a report
regarding the impacts of each proposed initiative.
The City Council met on December 16, 2014 to discuss the report. Subsequently, the
Council approved the consideration of a city -sponsored proposal to establish regulation
of medical marijuana dispensaries, and directed staff to develop a draft ordinance. The
City Council will vote in or around June 2016 to place the two proposed ballot initiatives
on the November 2016 ballot.
ANALYSIS:
The draft ordinance has been prepared by the City Attorney for review. Changes will be
incorporated into the final version of the ordinance that are reflective of City Council
requests. The City Council may provide staff with further direction as to the process to
present the ordinance or consider other alternatives.
ALTERNATIVES CONSIDERED:
The City Council may elect not to proceed with the city -sponsored ordinance.
LEGAL REVIEW:
Legal counsel has reviewed the draft ordinance and approved as to form.
CONCLUSION:
The Elections Code mandates the process for proceeding with a ballot measure. Staff
requests that Council provide direction regarding the draft ordinance as a part of the
process, and the scheduling of additional study session meetings.
