RECOMMENDATION:
Award professional services contract to California Forensic Phlebotomy, Inc., 27762
Antonio Parkway, Suite 1_1-647, Ladera Ranch, CA, for blood withdrawal testing
services for a three-year period for an amount not to exceed $91,000 per year.
2. Authorize the Mayor and the Deputy City Clerk to execute the Professional Services
Agreement.
3. Authorize the Chief Executive Officer to sign for any rate increases or any amount
above $91,000 as long as the increase falls within his signing authority.
BACKGROUND:
The Police Department requires blood withdrawal testing services to screen blood for
alcohol, drug content, and genetic markers. This contract provides professional licensed
personnel to respond when and where requested by Police personnel to draw blood for
evidence purposes and to testify in court when needed. Employees of the contractor
must be available on-call twenty-four hours a day, 365 days per year and they must also
be able to respond to any given location within 45 minutes.
California Forensic Phlebotomy Inc. has been providing blood withdrawal testing services
for the City of Costa Mesa for over 26 years. Currently, CFP is the sole source provider
of blood alcohol testing services for all Orange County law enforcement agencies.
On February 21, 2012, CFP was awarded Costa Mesa's blood withdrawal services
contract. In 2008, CFP was awarded the contract as a sole source contractor. On
November 22, 2005 CFP was awarded Costa Mesa's blood withdrawal services contract
after a formal bid process. The Police Department seeks to extend the agreement for
three additional year term.
ANALYSIS:
California Forensic Phlebotomy, Inc., submitted a rate quote of $92.00 each blood
withdrawal and an hourly rate of $117.75 for fixed posts (DUI checkpoints), with a
guaranteed three-hour minimum. The Police Department estimates approximately 840 tests
will be performed annually and that the fixed posts, such as DUI checkpoints will occur five
or six times annually. However, due to the fact that this approximation is based on a
fluctuating crime rate and officer self -initiated activities; blood withdrawal request could
either increase or decrease in number. The total annual expenditures for these services are
as follows:
• 2014 = $26,834
• 2013 = $65,656
• 2012 = $93,468
• 2011 = $78,546.
• 2010 = $74,349
• 2009 + $68,913
When blood withdrawals correspond to a DUI conviction, the City is reimbursed $37.00 per
case. To address the fluctuations and the potential for any future rate increase, the Police
Department is requesting the City CEO be authorized to sign for any amount which exceeds
$91,000 and falls under his signing authority.
ALTERNATIVES CONSIDERED:
No other alternatives have been considered.
FISCAL REVIEW:
The FY 15-16 budget provides funding for this service.
LEGAL REVIEW:
The City Attorney's office has reviewed and approved the attached Professional Services
agreement as to form.
CONCLUSION:
Currently California Forensic Phlebotomy inc. is the exclusive provider of this service for
all Orange County law enforcement agencies. It is recommended that City Council award
professional service contract to California Forensic Phlebotomy, Inc., for a three-year
price agreement of $92.00 each blood withdrawal and an hourly rate for fixed posts of
$117.75 in an amount not to exceed $91,000 per year and to authorize the Mayor and
the Deputy City Clerk to execute the Professional Services Agreement.
