A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA, ORDERING
THE VACATION OF EXCESS RIGHT-OF-WAY AT
297 OGLE STREET (SANTA ANA AVENUE SIDE)
WHEREAS, the City Council of the City of Costa Mesa did, on the 3`d
day of January, 2006, adopt Resolution No. 06-4, entitled: " A RESOLUTION OF
THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA,
DECLARING ITS INTENTION TO ORDER THE VACATION OF EXCESS
RIGHT-OF-WAY AT 297 OGLE STREET (SANTA ANA AVENUE SIDE).
WHEREAS, pursuant to said Resolution of Intention, the time and place
for hearing all persons interested in or objecting to the proposed vacation was
set for Tuesday, the 7th day of February, 2006, at 6:30 p.m., in the Council
Chambers of City Hall, 77 Fair Drive, Costa Mesa, California; and
WHEREAS, notices of said proposed vacation were duly and regularly
posted as required by law, all pursuant to the provisions of Section 8300 et seq.
of the Streets and Highways Code of the State of California; and
WHEREAS, on said date of hearing, the proposed vacation came on
regularly to be heard; all persons appearing on the proposed vacation were
heard; and said hearing was closed on the 7th day of February, 2006; and
WHEREAS, the Costa Mesa City Council finds and determines from all
the evidence submitted that the hereinafter described right-of-way is
unnecessary for present or prospective street purposes;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA
MESA DOES ORDER AND RESOLVE AS FOLLOWS:
1. That the hereinafter described right-of-way is unnecessary for present
or prospective street purposes.
2. It is hereby ordered that the following described right-of-way be, and
the same are hereby vacated:
All as more particularly described in legal description shown in Exhibit "A"
and on map shown in Exhibit "B," attached hereto and by this reference
made a part hereof.
PASSED AND ADOPTED this 7th day of February, 2006.

LEGAL DESCRIPTION OF THE VACATION OF A PORTION OF
SANTA ANA AVENUE
A portion of Lot 10, Tract No. 2996, in the City of Costa Mesa, County of Orange, State
of California, as shown on a map recorded in Book 116, pages 21-22, of Miscellaneous
Maps, records of said Orange County, said land being a portion of that portion of Parcel 2
of a parcel map recorded in Book 63, page 6, of Parcel Maps, records of said Orange
County shown as "Santa Ana Avenue" on said Parcel Map, described as follows:
Beginning at the southerly corner of said Lot 10; thence along the southwesterly line of
said Lot 10 North 49159'20" West 7.00 feet; thence along a line parallel with and 7.00
feet northwesterly of the southeasterly line of said Lot 10 North 40°00'35" East 110.00
feet to a tangent curve, concave westerly, having a radius of 15.00 feet; thence northerly
and northwesterly along said curve 23.56 feet through a central angle of 89°59'55" to a
point on the northeasterly line of said Lot 10, said point being South 49°59'20" East
80.70 feet from the northerly comer of said Lot 10; thence southeasterly along said
northeasterly line of said Lot 10 South 49°59'20" East 7.00 feet; thence South 45°00'03"
East 21.41 feet to a point on the southeasterly line of said Lot 10, said point being the
northeasterly terminus of that course shown as North 40°00'35" East 110.00 feet" in the
boundary of said Lot 10 as shown on said Tract No. 2996; thence along said southeasterly

RESERVING THEREFROM a public utility easement for all existing underground and
overhead public utilities together with right of ingress and egress for the purpose of
maintaining, replacing and upgrading said existing public utilities.
