RESOLUTION NO. 06-95
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, ORDERING THE
VACATION OF A PORTION OF EL CAMINO DRIVE,
MENDOZA DRIVE AND CORONADO DRIVE ADJACENT
TO 1011-1045 EL CAMINO DRIVE AND AT 2805 & 2829
SAN JUAN LANE SUBJECT TO CONDITIONS.
WHEREAS, the City Council of the City of Costa Mesa did, on the 21St day of
June, 2005, adopt Resolution No. 06-67, entitled: "A RESOLUTION OF THE CITY
COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING ITS
INTENTION TO ORDER THE VACATON OF EXCESS RIGHT-OF-WAY ON EL
CAMINO DRIVE, MENDOZA DRIVE, AND CORONADO DRIVE ADJACENT TO 1011
EL CAMINO DRIVE AND ADJACENT TO 2805 & 2829 SAN JUAN LANE.
WHEREAS, pursuant to said Resolution of Intention, the time and place for
hearing all persons interested in or objecting to the proposed vacation was set for
Tuesday, the 19th day of September, 2006; at 7:00 p.m., in the Council Chambers of
City Hall, 77 Fair Drive, Costa Mesa, California; and
WHEREAS, notices of said proposed vacation were duly and regularly posted as
required by law, all pursuant to the provisions of Section 8300 et seq. of the Streets and
Highways Code of the State of California; and
WHEREAS, at said meeting the hearing was continued to Tuesday, November
7, 2006, at 7:00 p.m.; and
WHEREAS, on October 3, 2006, the City Council cancelled said meeting and
rescheduled for Tuesday, November 14, 2006, thereby continuing said hearing to
November 14, 2006, at 7:00 p.m.; and
WHEREAS, said hearing was there again continued from November 14, 2006, to
November 21, 2006 at 7:00 p.m.; and
WHEREAS, on said date of continued hearing, the proposed vacation came on
regularly to be heard; all persons appearing on the proposed vacation were heard; and
said hearing was closed on the 21St day of November, 2006; and
WHEREAS, the Costa Mesa City Council finds and determines from all the
evidence submitted that the hereinafter described right-of-way is unnecessary for
present or prospective street purposes so long as the conditions included herein are
met;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA
DOES ORDER AND RESOLVE AS FOLLOWS;
1. That the hereinafter described right-of-way is unnecessary for present or
prospective street purposes so long as the conditions included herein are
met.
2. It is hereby ordered that the following described right-of-way be, and the
same shall hereby be vacated upon satisfaction of the conditions set forth
herein:
All as more particularly described in legal descriptions shown in Exhibits Al, A2
AND A3, and on maps shown in Exhibits B1, B2 AND B3 attached hereto and by
this reference made a part hereof.

SUBJECT TO THE FOLLOWING CONDITIONS;
1. Recordation of Tract Map No. 16917 must take place within 6 months of the
date of adoption of this resolution.
2. Street Improvement plans for all public right-of-way affected by the vacation
must be approved prior to the recordation of Tract Map No. 16917.
