Home My WebLink About02 - SM-1 - Attachment 1 - 12/13/2016ATTACHMENT 1 RESOLUTION NO. 16-86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, RECITING THE FACTS OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2016; DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a General Municipal Election was held and conducted in the City of Costa Mesa, California, on Tuesday, November 8, 2016, as required by law; and WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed; and that in all respects, the election was held and conducted, and votes were cast, received, and canvassed, and the returns made and declared in time, for, and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and WHEREAS, the Registrar of Voters of the County of Orange canvassed the returns of the election, and has certified the results to this City Council, and the results are received, attached, and made a part hereof as Exhibit "A"; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS: SECTION 1. That the whole number of ballots cast in the precincts was 19,601, the whole number of early voting ballots cast was 1,741, the whole number of vote -by - mail ballots cast was 22,379, making a total of 43,721 ballots cast in the City. SECTION 2. That the names of persons voted for at the election for Member of the City Council are as follows: Sandra L. Genis, Jay Humphrey, Allan R. Mansoor, Resolution No. 16-86 Page 1 of 7 Al Melone, Steve Mensinger, Lee Ramos, and John Stephens; and That the measures voted upon at the election are as follows: Measure V: Allow Operation of up to Eight Medical Marijuana (Cannabis) Businesses in the City of Costa Mesa Response Vote Shall the ordinance, to allow operation of up to eight medical marijuana (cannabis) businesses with: six percent tax on Yes medical marijuana (estimated annual tax revenues $48,000 to $912,000); one percent tax on other products; exemption from permits; regulations not subject to change by City No Council except for increasing businesses; precedence to prior businesses; and locations limited to commercial and industrial areas, be adopted? Measure W: Allow Operation of up to Four Licensed Medical Marijuana Businesses in the City of Costa Mesa Response Vote Shall the ordinance, to allow operation of up to four medical marijuana businesses with: six percent tax on medical Yes marijuana (estimated annual tax revenues $24,000 to $456,000); required industry specific licenses; required operator permits; regulations subject to change by City No Council including increasing businesses; precedence to prior businesses; and locations limited to commercial and industrial areas, be adopted? Resolution No. 16-86 Page 2 of 7 Measure X: The City of Costa Mesa Medical Marijuana Measure Response Vote Shall the ordinance, to allow medical marijuana manufacturing, processing, wholesale distribution and Yes transporting, and research, development and testing, in manufacturing and industrial zones north of South Coast Dr. and west of Harbor Blvd., subject to conditional use permit No and business permits, including requirements for background checks, premises security, business records, that is subject to amendment by City Council, and that levies an annual 6% gross receipts tax (estimated annual revenue $48,000 - $912,000), be adopted? Measure Y: An Initiative To Require Voter Approval On Certain Development Projects Response Vote Shall the ordinance to require voter approval of development projects that require adoption, amendment, change or Yes replacement of the General Plan, the Zoning Code, a specific plan, or an overlay plan, and that generates over 200 additional trips, increases intersection volume/capacity, No changes the intersection utilization/level of service, adds 40 or more dwelling units, adds 10,000 sq.' of non-residential use, or changes a public use to a private use under specified conditions, be adopted? Measure EE: Voter Districts Formation Response Vote Shall members of the legislative body of the City of Costa Mesa be elected by district as described in Ordinance No. Yes 16-05, establishing six equal, geographically based districts, and the Mayor of the City of Costa Mesa elected on a citywide basis for a term of two years by the voters of No the entire city, for a maximum of two terms? SECTION 3. That the number of votes given at each precinct and the number of votes given in the City to each of the persons above named for Member of the City Council and for and against the measures V, W, X, Y, Z, AA, BB, and EE are as listed in Exhibit "A" attached. Resolution No. 16-86 Page 4 of 7 SECTION 4. The City Council does hereby declare and determine that Sandra L. Genis, Allan R. Mansoor, and John Stephens were elected as Members of the City Council for the full term of four years; and That as a result of the election, a majority of the voters voting on Measure V, relating to "Allow Operation of up to Eight Medical Marijuana (Cannabis) Businesses in the City of Costa Mesa", did not vote in favor of it, and that the measure was not carried and shall not be deemed adopted and ratified. That as a result of the election, a majority of the voters voting on Measure W, relating to "Allow Operation of up to Four Licensed Medical Marijuana Businesses in the City of Costa Mesa", did not vote in favor of it, and that the measure was not carried and shall not be deemed adopted and ratified. That as a result of the election, a majority of the voters voting on Measure X, relating to `The City of Costa Mesa Medical Marijuana Measure", did vote in favor of it, and that the measure was carried, and shall be deemed adopted and ratified. That as a result of the election, a majority of the voters voting on Measure Y, relating to "An Initiative To Require Voter Approval On Certain Development Projects", did vote in favor of it, and that the measure was carried, and shall be deemed adopted and ratified. That as a result of the election, a majority of the voters voting on Measure Z, relating to the "Measure for Sensible Community Development and Development - Funded Open Space and Recreation", did vote in favor of it, however, Measure Z conflicts with Measure Y, and Measure Y received a higher majority of votes cast, and therefore Measure Z shall not be deemed adopted and ratified, except for those Resolution No. 16-86 Page 5 of 7 provisions that do not conflict with Measure Y. That as a result of the election, a majority of the voters voting on Measure AA, relating to "An Initiative Requiring Changes in Use at Fairview Park be Subject to Voter Approval', did vote in favor of it, and that the measure was carried, and shall be deemed adopted and ratified. That as a result of the election, a majority of the voters voting on Measure BB, relating to "Costa Mesa Measure Prohibiting Athletic Fields at Fairview Park", did not vote in favor of it and that the measure was not carried and shall not be deemed adopted and ratified. That as a result of the election, a majority of the voters voting on Measure EE, relating to "Voter Districts Formation", did vote in favor of it and that the measure was carried, and shall be deemed adopted and ratified. SECTION 5. The City Clerk shall enter into the records of the City Council of the City, a statement of the results of the election showing: (1) The whole number of ballots cast in the City; (2) The names of the persons voted for; (3) The Measures voted upon; (4) The office for which each person was voted for; (5) The total number of votes at each precinct to each person, and for and against each measure; (6) The total number of votes given to each person, and for and against each measure. SECTION 6. The City Clerk shall immediately make and deliver to each of the persons so elected, a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to each person elected, the Oath of Office prescribed in the Constitution of the State of California, and shall have them subscribe to Resolution No. 16-86 Page 6 of 7 it and file it in the office of the City Clerk. Each and all of the persons so elected shall be inducted into the respective office to which they have been elected. SECTION 7. The City Clerk shall certify to the passage and adoption of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED this 13th day of December, 2016.
