Consider releasing the appointment of commissioners whose terms expire in 2019 and 2021, effective January 4, 2017; and 2. Direct the City Clerk to post the special vacancy notices pursuant to GC §54974(a), and to proceed with a recruitment for new commissioners; and 3. Consider scheduling a Special Meeting on Tuesday, January 24, 2017 to interview the applicants; and 4. Consider scheduling a Special Meeting on Tuesday, January 31, 2017, to complete the interview of applicants and to make the appointments to the commissions. BACKGROUND: The Planning Commission consists of five appointed positions which serve staggered four-year terms, as follows: Colin McCarthy Term expires Feb. 1, 2017 Timothy Sesler Term expires Feb. 1, 2017 Stephan Andranian Term expires Feb. 1, 2019 Robert Dickson Term expires Feb. 1, 2019 Jeff Mathews Term expires Feb. 1, 2019 Planning Commissioners must be registered voters in the City. 1 The Parks and Recreation Commission consists of five appointed positions which serve staggered four-year terms as follows: Kim Pederson Term expires Feb. 1, 2017 Julie Mercurio Term expires Feb. 1, 2017 Byron de Arakal Term expires Feb. 1, 2019 Brett Eckles Term expires Feb. 1, 2019 Robert Graham Term expires Feb. 1, 2019 Parks and Recreation Commissioners must be registered voters in the City. The Senior Commission consists of seven appointed positions which serve staggered four-year terms as follows: John McGlinn Term expires Feb. 1, 2017 Sue Healey Term expires Feb. 1, 2017 Kirk Bauermeister Term expires Feb. 1, 2019 Ann Perry Term expires Feb. 1, 2019 Lee Ramos Term expires Feb. 1, 2019 Gary Parkin Term expires Feb. 1, 2021 Vacancy (Janet Krochman resigned 11/16/16) Senior Commissioners must be residents in the City. According to the Costa Mesa Municipal Code Title 2, Section 2-4, under Section (b) "City Council Policies; Commissions, Boards and Committees; Terms and Procedures", All members will serve at the sole pleasure of the City Council and may be removed at any time without cause. Should City Council proceed with the release from appointments, the unscheduled position vacancies shall be posted on January 4, 2017. The City Clerk shall proceed with recruitments for the new Commissioners January 4, 2017 to January 18, 2017. City Council may proceed with scheduling a Special Meeting on January 24, 2017, to interview the applicants. Additionally, City Council may schedule a Special Meeting on January 31, 2017 to complete the interviews and to make the appointments to the commissions. If the City Council proceeds with the release of appointments of a majority of a commissions members, no commission meeting will occur until after the new commissioners are appointed. ANALYSIS: Members appointed to the Commissions may be terminated by the action of the City Council. The Council Policy does not require a need to show cause for such an action. ALTERNATIVES CONSIDERED: 1. Mayor Foley has suggested that for the interview process each Council Member identify their top two choices to interview for each commission. This would potentially identify up to ten applicants for each commission to be interviewed. 2. City Council may consider appointing an ad hoc committee of two council members to interview applicants and make recommendations to council. 3. City Council schedule the appointments to the commissions for the regular City Council meeting of February 7, 2017. 2 FISCAL REVIEW: None. The persons appointed serve at the pleasure of the City Council. The commissioners' terms are for four years except that initial appointments under Ordinance number 04-17 for two of the Planning Commissioners and two of the Parks and Recreation Commissioners, chosen randomly, shall be for two years in order to have staggered terms. PURPOSE To establish certain procedures governing the appointment of Planning and Parks and Recreation commissioners and related matters. PRACTICES AND PROCEDURES 1. Appointments a. The City Manager will put on the City Council agenda for the second regular City Council meeting in January following each General Election the matter of appointment of commissioners for the Planning Commission and Parks and Recreation Commission. Appointments will be needed to fill any vacancies caused by the expiration of commission member terms. b. The City Manager will give advance notice of the calendaring of this matter to the Council Members. c. Prior to the scheduled Council meeting, the City Manager will also cause public notice to be given of the number and type of commission appointments to be made and invite any interested persons to submit to his office their name, resume, and statement of interest in the commission appointment desired. All such applications received will be supplied to the Council Members. d. At the scheduled Council meeting when this matter is called for consideration, each Council Member may make nominations of persons to be appointed to each commission to be voted on by the entire council. Qualifications a. Commissioners must be residents and qualified electors of the City. The City Clerk shall verify that applicants satisfy these qualifications. b. No commissioner shall be a regular, full-time employee of the City, nor a Council Member. c. The Council Members shall select their nominee(s) based on the individual Council Member's judgment that his or her nominee(s) are the best qualified persons for these commissions. d. The appointments shall be from among persons who have submitted applications. 3. Terms a. Each commissioner will serve a term of four years except that upon initial appointment following adoption of this Policy Revision and Ordinance Number 04- 17, two members of each commission, selected at random, shall serve a term of two years. b. Notwithstanding subdivision 3.a above, a commissioner will continue to serve until a replacement commissioner has been appointed and qualified. c. A commissioner's term shall automatically terminate upon his or her ceasing to be qualified under section 2 above. 4. Removal a. A Council Member may request consideration of removal of a Commissioner by placing the removal on a Council agenda. b. When this matter is called for consideration, The City Council may remove any member of either commission by majority vote. Compensation Compensation for the commissioners will be set from time to time by City Council resolution. 6. Absences The provisions in Costa Mesa Municipal Code, section 13-10(d) and (e) describing excusable absences and absences resulting in termination of office shall govern both Planning and Parks and Recreation commissioners. An absence without cause from three consecutive meetings shall automatically end a commissioner's term of office. 7. Additional Policies Except as provided in this policy, the Planning Commission and Parks and Recreation Commission shall be guided by the policies set forth in the Commissions/Committees/Boards Handbook. In case of any inconsistencies between this policy and the Handbook, the provisions in this policy shall govern these commissions. (a) Policies adopted by city council shall have the same effect as a resolution adopted by city council. (b) All commissions, boards and committees appointed by the city council, except as otherwise provided by the city council in this Code or by policy or as otherwise required by law, shall consist of five (5) members with each member having a term of office of four (4) years, provided, that in order to have overlapping terms, two (2) or three (3) members may initially be assigned two-year terms. The term of any member shall be automatically extended, if necessary, until his or her replacement is appointed. All members will serve at the sole pleasure of the city council and may be removed at any time without cause. (c) The procedures applicable to commissions, boards and committees are those specified by this Code and policies adopted by city council.
