RECOMMENDATION:
Staff recommends that the City Council:
1. Approve Amendment One to the existing Professional Services Agreement
(Attachment 2) with MPS Consulting, Inc. to perform development -related
project management consulting services in an additional amount not to exceed
$50,000; and
2. Authorize the City Manager and City Clerk to execute the agreement; and
3. Authorize the City Manager and City Clerk to accept and execute future
amendments to the agreement.
BACKGROUND:
In September 2016, the City entered into a Professional Services Agreement (PSA)
with MPS Consulting, Inc. to retain Ms. Peggy Schneble to provide development -related
project management consulting services. Since September, Ms. Schneble has
augmented the Development Services staff serving in an Interim Assistant Director of
Development Services. Ms. Schneble continues to oversee the day-to-day operation of
the Planning Division related to processing of development applications by the public
and the development community. She manages all tasks related to the Planning
Commission, such as public noticing, staff report review, coordination with
Commissioners and attending meetings. Since the voters approved Measures X and Y
in November, she has been instrumental in developing administrative regulations to
implement the provisions. In particular, Measure Y impacts the workflow as it relates to
processing of applications in the City. Ms. Schneble is also assisting the Working Group
established to define the city processes to implement Measure X. Her role is to prepare
the administrative regulations for Measure X related to the conditional use permit
process.
The initial contract with MPS Consulting, Inc. was for $49,000. Due to the workload
needs of the department and ballot measure implementation, the amount allocated to
the current contract is set to run out soon.

In order to fund the remainder of the term, we are asking for the Council to authorize
$50,000 of additional funds toward this contract from FY 2016-17 contingency. Based
on current staffing needs, workload, and increase in projects, staff believes that
development -related management consulting assistance is essential to functions of the
Development Services Department. The City intends to fill the role of Assistant Director
of Development Services with a full-time staff person shortly after the new Economic
and Development Services Director is hired. Attached is Amendment One to the
Professional Services Agreement (PSA) with MPS Consulting, Inc. to allow Ms.
Schneble to continue to carry out the current scope explained above until the permanent
position is filled.
ALTERNATIVES CONSIDERED:
The alternative to the proposed City Council action would be to not move forward with
the contract for the stated development -related project management consulting. Due to
the volume of work and large number of projects currently being handled by the
Planning Division, a significant lack of supervision/implementation of current projects
would be experienced.
FISCAL REVIEW:
Funding for this amendment is to come from FY 16-17 contingency.
LEGAL REVIEW:
The City Attorney's Office has reviewed the attached Professional Services Agreement
Amendment and approved it as to form.
CONCLUSION:
Staff recommends that the City Council authorize the City Manager to execute an
amendment to the Professional Services Agreement with MPS Consulting, Inc. to perform
development -related project management consulting services in amount not to exceed
$50,000.

AMENDMENT NUMBER ONE
TO PROFESSIONAL SERVICES AGREEMENT
WITH
MPS CONSULTING, INC.
This Amendment Number One ("Amendment") is made and entered into this 7th day of
March, 2017 ("Effective Date"), by and between the CITY OF COSTA MESA, a municipal
corporation ("City"), and MPS CONSULTING, INC., a California corporation ("Consultant").
WHEREAS, City and Consultant entered into an agreement on September 19, 2016 for
Consultant to provide development -related project management assistance on an as -needed
basis (the "Agreement"); and
WHEREAS, City and Consultant initially contemplated that Consultant would provide
approximately twenty-five (25) hours per week of services; and
WHEREAS, City requires more than 25 hours per week of Consultant's services, and City
desires to increase Consultant's maximum compensation accordingly to Ninety -Nine Thousand
Dollars ($99,000.00).
NOW, THEREFORE, for valuable consideration, the receipt and sufficiency of which is
hereby acknowledged, the parties agree as follows:
Section 2.1 of the Agreement shall be amended to reflect that Consultant's total
compensation shall not exceed Ninety -Nine Thousand Dollars ($99,000.00).
Consultant shall be paid according to the fee schedule set forth in the Agreement.
2. All terms not defined herein shall have the same meaning and use as set forth in
the Agreement.
3. All other terms, conditions, and provisions of the Agreement not in conflict with this
Amendment shall remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment to be executed
by and through their respective authorized officers, as of the date first written above.
