Recommendation: The City Council should place appropriate limits on any delegation of authority to
approve further amendments to the existing contract.
Consent Calendar item No. 6 is an amendment increasing the maximum compensation under a
professional services contract for management of Planning Division matters. The original contract
was funded at $49,000, out of the FY 2016-2017 budget. The amendment itself appears to present no
problems.
However, according to the agenda, the Council is asked also to authorize the City Manager to
approve future amendments to the contract, and this requested authority is entirely open-ended.
While I definitely do not expect our City Manager to abuse this authority, the lack of limits on such
authority is at least bad form and possibly an unconstitutional delegation of the Council's authority. It
would authorize changing the compensation rate, the total compensation, the nature of the work, the
duration of the contract, etc.
Therefore, I ask the City Council to place appropriate limits on any such delegation of authority to
approve further amendments to this contract.

Subject: Access Building, Fire and Housing Board of Appeal
Dear City Council,
Coming before you is a recommended change to this board.
1. Access Building, Fire and Housing Board of Appeal
1.1. Keep this Committee of five members and two alternates, each serving four year terms, to maintain a
separate board of appeals to hear cases related to accessibility, building, fire and housing code
determinations. The meetings shall be held on an as needed basis at City Hall. The staff liaison to the
board should be the building official and the fire chief.
1.2. Approve the following minimum qualifications for members of the board of appeals to ensure they
possess the education, training and expertise necessary to review determinations of the building official
and fire marshal. Minimum qualifications of board members should include:
a. Civil engineers
b. Structural engineers
c. Fire protection engineers
d. Electrical/mechanical engineers
e. Architects
f. Certified Access Specialists (CASp)
g. Related state or federal licensed professionals, such as fire marshals
I have served on this board for about 15 years, starting as an alternate for about 2-4 years. The last 5 +years I have
served as the chairman. During my tenure on this committee we have had about 7 issues come up before our board. We
have never had a fire issue come up before this board nor did we ever see anyone from the Fire Department at our
meetings. The staff liaison was led by Khanh Nguyen. The majority of issues were about building permits, handicap
access at South Coast Plaza, property maintenance issues, a dispute over a neighbor's back yard retaining wall that was
approved by city staff and the 1't one I can remember was a dispute over conditions in alley in Mesa North between the
city and an owner.
I see several issues not addressed with the staff recommendations:
1. Does the member have to be a resident of Costa Mesa- we have several members that do not live in this city on
our board presently, I am fine with this since it is very difficult to fill this board.
2. Khanh had made it a point to have someone on the committee with handicap needs.
3. 1 think another type of applicant should be someone like myself who has knowledge of real estate rights,
construction knowledge and familiarity with our building codes that change every few years with the
International code standards. I guess I would fall under item g., since I am licensed by the state.
I am available to discuss the staff recommendations prior to the meeting, I unfortunately most likely will not be able to
make the meeting that night to speak as my son has orientation that night for College Football.
