HomeMy WebLinkAbout06 - CC-6 - Final Map for Tract No.17980 - 4/4/2017CITY COUNCIL AGENDA REPORT MEETING DATE: APRIL 4, 2017 ITEM NUMBER: CC -6 SUBJECT: FINAL MAP FOR TRACT NO. 17980 LOCATED AT 929 BAKER STREET, COSTA MESA, CALIFORNIA DATE: MARCH 23, 2017 FROM: PUBLIC SERVICES DEPARTMENT/ENGINEERING DIVISION PRESENTATION BY: RAJA SETHURAMAN, PUBLIC SERVICES DIRECTOR FOR FURTHER INFORMATION CONTACT: BALTAZAR MEJIA, CITY ENGINEER, AT 714-754-5335 RECOMMENDATION: Adopt a Resolution (Attachment 1) finding that Government Code section 65402 shall not apply to the abandonment of a storm drain easement through the filing of a Final Map for Tract 17980. Approve the Final Map Tract No. 17980 for Condominium purposes (Attachment 2) and authorize signing of the Map by the City Clerk and the City Engineer. BACKGROUND: The Vesting Tentative Map for Tract No. 17980 and Conditions of Approval were approved by the Planning Commission on July 25, 2016 (Attachment 3). The Map consists of a subdivision of a 4.71 -acre lot for condominium purposes to construct 56 residential units. ANALYSIS: This map is a subdivision of a portion of lot 17 in Block B of the Berry Tract, as per map recorded in book 9 page 6 of miscellaneous records, in the office of the County recorder of Los Angeles County, California. The Final Map is in substantial conformance with the Vesting Tentative Map approved by the Planning Commission. The Tract Map has been checked and found to be technically correct, and includes the release and relinquishment of access rights to Baker Street, an easement for emergency and public security vehicle purposes and an easement for sidewalk purposes to be accepted by the City. Also, this map includes the abandonment of an easement for storm drain and appurtenant and incidental purposes pursuant to sections 66499.20.2 and 66434(g) of the Subdivision Map Act. This easement was acquired and recorded on October 16, 1984 to construct a storm drain inlet on private property. The City has no present or future need for this easement since it only benefited the subject property. 1 ALTERNATIVES CONSIDERED: No alternatives were considered. FISCAL REVIEW: All Tract Map filing fees have been paid. LEGAL REVIEW: The City Attorney's Office has approved the attached Resolution as to form. CONCLUSION: Staff recommends that the City Council adopt the Resolution, approve the Final Map and authorize the City Clerk and the City Engineer to sign the Map. The Tentative Map 17980 for a subdivision to construct a 56 -unit, two story, detached residential common interest development and Conditions of Approval were approved by the Planning Commission on July 25, 2016; and 2. The Final Map is in substantial conformance with the Tentative Map approved by the Planning Commission; and 3. The Tract Map has been checked and found to be technically correct, and includes the ingress and egress easement for emergency and public security vehicle purposes, the release and relinquishment of access rights and public sidewalk easement to be accepted by the City; and 4. On July 25, 2016, the Tentative Map has been submitted to the Planning Commission, and pursuant to California Government Code 65402, it has been determined to be in substantial conformity with the City's 2035 General Plan; and 5. The City has no future or present need for the storm drain easement dedicated on October 16, 1984 as Instrument 84-426937 of Official Records. for the purpose of constructing a catch basin; and 1 6. The abandonment of such portion via notation on the Final Map is of a minor nature and would be in conformity with the original purpose of acquisition of the easement; and NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES ORDER AND RESOLVE AS FOLLOWS: 1. Therefore, Government Code Section 65402 shall not apply to the abandonment of the storm drain easement through filing of a Final Tract map for Tract No. 17980. 2. Pursuant to the requirement of Government Code 66499.20.2 and 66434(g), the City clerk is hereby authorized and directed to certify such notations. Tentative Tract Map No. 17980 meets with the approval of the Public Services Department, subject to the following conditions: 1. The subdivider's engineers shall furnish to the Engineering Division a storm runoff study showing existing and proposed facilities and the method of draining this area and tributary areas without exceeding the capacity of any street or drainage facility on-site or off-site to the satisfaction of the City Engineer. This study is to be furnished with the first submittal of the Final Map. Cross lot drainage shall not occur. Ownership and maintenance of the private on- site drainage facilities and parkway culverts and other common areas shall be transferred by owner to the Homeowners Association to be formed pursuant to C.C.M.M.C. Section 13-41. 12. Maintain the public Right -of -Way in a "wet -down" condition to prevent excessive dust and remove any spillage from the public Right -of -Way by sweeping or sprinkling. 13. All Haul routes must be approved by the City of Costa Mesa, Transportation and Engineering Divisions. 14. The subdivider shall conduct soil investigations and provide the results to the City of Costa Mesa Engineering and Building Divisions pursuant to Ordinance 97-11 and section 66491 of the Subdivision Map Act. 15. Prior to recordation of a Final Tract Map, the surveyor/engineer preparing the map shall tie the boundary of the map into the Horizontal Control System established by the County Surveyor in a manner described in Subarticle 12, Section 7-9-337 of the Orange County Subdivision Code. 16. Priorto recordation of a Final Tract Map, the surveyor/engineer preparing the map shall submit to the County Surveyor a digital -graphics file of said map in a manner described in Subarticle 12, Section 7-9-337 of the Orange County Subdivision Code. 17. Survey monuments shall be preserved and referenced before construction and replaced after construction, pursuant to Section 8771 of the Business and Profession Code. 18. The elevations shown on all of the subdivision plans shall correspond with the Orange County benchmark datum. 19. Prior to recordation of the Final Tract Map, submit required cash deposit or surety bond to guarantee monumentation. Deposit amount to be determined by the City Engineer. 2 20. Prior to Tract occupancy, the surveyor/engineer shall submit to the City Engineer a Digital Graphic File, reproducible mylar of the recorded Tract Map, and approved off-site plan and seven copies of the recorded Tract Map. 21. Prior to issuance of any Engineering Permits by the City of Costa Mesa the subdivider shall pay Final Map and Offsite Improvement Plan Check fees per Section 13-231 of the C.C.M.M.C. 22. The subdivider shall remove any existing driveway approaches and/or curb depressions that will not be used and replace with full height curb and sidewalk. per the approved offsite improvement plans. All work shall meet the City of Costa Mesa Standards and ADA requirements. 23. Obtain a permit from the City of Costa Mesa, Engineering Division, at the time of development and then construct P.C.C. driveway approach on Baker Street per City of Costa Mesa Standards as shown on the Offsite Improvement Plan. Location and dimensions are subject to the approval of the Transportation Services Manager. ADA compliance required for new driveway approach. 24. A Moratorium is in place on Baker Street for any cut in the street. The subdivider shall follow the moratorium resurfacing requirements of the City of Costa Mesa whenever a street cut is necessary for providing utility connections or any other reason for the purpose of serving the subdivision. All work shall conform to the City Standards and as required by the City Engineer. 25. The subdivider shall provide for a clear 4 -foot sidewalks around all obstructions along the entire property frontage on Baker Street to meet the ADA requirements. All work shall meet the City of Costa Mesa Standards. 26. The subdivider shall collect all the drainage from the private drive and convey it through a curb drain to the street. All work shall be in conformance with the City of Costa Mesa Standards. No storm water shall sheet flow over the driveway approach. 27. Submit required cash deposit or surety bond to guarantee construction of off-site street improvements at time of permit per Section 15-32, C.C.M.M.C. and as approved by City Engineer. City Engineer 9 ATTACHMENT 4 THIRD AMENDMENT TO PROFESSIONAL SERVICES AGREEMENT WITH WHITE NELSON DIEHL EVANS LLP This Third Amendment ("Amendment") is made and entered into this 4th day of April, 2017 ("Effective Date"), by and between the CITY OF COSTA MESA, a municipal corporation ("City"), and WHITE NELSON DIEHL EVANS LLP, a limited liability partnership ("Consultant"). WHEREAS, City and Consultant entered into an agreement on May 1, 2013 for Consultant to provide financial reporting and auditing services (the "Agreement"); and WHEREAS, pursuant to Section 4.1 of the Agreement, City and Consultant previously extended the term of the Agreement through June 30, 2017; and WHEREAS, City and Consultant now desire to extend the term of the Agreement for one (1) year, through June 30, 2018, and to set forth Consultant's compensation for the extended period accordingly.
