RECOMMENDATION:
Adopt plans, specifications, and working details for the TeWinkle Park ADA and Parking Lot
Improvements Project, 970 Arlington Drive, Costa Mesa, CA, 92626, City Project No. 17-01.
2. Award a construction contract to All American Asphalt, 400 E. Sixth Street, Corona, CA 92879, in
the amount of $220,272.00.
3. Authorize the Mayor and the City Clerk to execute the Public Works Agreement.
BACKGROUND:
The Americans with Disabilities Act (ADA) is a federal civil rights law enacted in 1990 to provide
persons with disabilities with accommodations and access equal to, or similar to, those available to
the general public, including accessible parking lots. Title III of the ADA requires that owners of
buildings that are considered to be places of public accommodations remove architectural and
communications barriers to allow use of the facilities by persons with disabilities.
An ADA survey for TeWinkle Park has been completed and identified a number of deficiencies that
included parking lot grades, location of parking spaces, signage, and ramps. Other areas identified
for ADA upgrades include concrete walkways along the path of travel to various elements of the
park. Attachment 1 describes a typical finding from the ADA survey report prepared by Q3
Engineers, Inc. The scope of work under this project includes resurfacing the parking lot to bring the
surface grades to ADA standards; striping of parking stalls; installation of ADA signage;
reconstruction of walkways that were identified as non-compliant with ADA standards, and other
incidental work needed to complete the project in accordance with the contract documents. Copies
of the project plans, specifications and reports are available for review in the Public Services
Department and on the City's webpage at costa mesaca.gov.
ANALYSIS:
The City Clerk received and opened eight (8) bids for this project on April 11, 2017. All American
Asphalt was the apparent low bidder with a bid proposal of $220,272.00. The Engineer's estimate
was $322,945.00; and the average of the eight (8) bids received amounted to $293,143.54.
An analysis of the bids indicates that the apparent low bidder submitted a bid proposal that is
31.79% lower than the Engineer's estimate. The variance between the low bidder and the Engineer's
estimate may be attributed to the highly competitive conditions for this type of contracts at this time.

The license and references of All American Asphalt were checked and staff has found them to be in
good standing. All American Asphalt has successfully completed several projects in the City of
Costa Mesa including the Eastside Street Maintenance Project, intersection improvements at Harbor
Boulevard and Adams Avenue, 19th Street Rehabilitation from Newport Boulevard to Park Avenue
and most recently, the Harbor Boulevard Improvements Project from South Coast Drive to
Sunflower Avenue.
ALTERNATIVES CONSIDERED:
The alternative to this Council action would be to reject all the bids. If all the bids are rejected, the City
would need to readvertise or cancel the project. Staff believes that readvertising the project will not
result in lower bids.
FISCAL REVIEW:
Funding for this project has been budgeted in Fiscal Year 2015-2016 from CDBG Grant Funds and
Capital Improvements Funds.
LEGAL REVIEW:
All American Asphalt has furnished the necessary bonds and insurance, which were approved as to
form by the City Attorney. After the award and subsequent execution of the contract, a "Notice to
Proceed" will be issued.
The advertisement and bid opening for the TeWinkle Park Parking Lot Improvements Project, City
Project No. 17-01, has been completed. It is recommended that the City Council adopt the plans,
specifications, and working details for said project; award the contract to the apparent low bidder, All
American Asphalt, in the amount of $220,272.00; and authorize the Mayor and the City Clerk to
execute the Public Works Agreement.

1) Curb ramp on south end of parking lot on Junipero Drive is not level at bottom transition. The
slopes on the flared sides are in excess of 1:10. There are no detectable warnings. There are no
