RECOMMENDED ACTION:
1. Reject all bids.
2. Authorize staff to re -advertise the project
BACKGROUND:
This project proposes construction of a linear park -like area with a vegetated bioswale and a
multipurpose trail along the south side of Arlington Drive from Newport Frontage Road to Fairview
Road. The work also includes construction of storm drain facilities in partnership with the Orange
County Fairgrounds and the relocation of interfering portion of an existing Orange County Water
District's reclaimed water transmission mainline.
In early 2014, the City was successful in capturing $1,690,000 in Environmental Cleanup funds to
design and construct the Arlington Drive Bioswale and Dry Weather Diversion Project. Also, the
Orange County Fair & Event Center (OCFEC) has provided their contribution in the amount of $1.5
million toward the construction of storm drain improvements.
ANALYSIS:
On April 27, 2017 the City Clerk received and opened five (5) bids for this project. The apparent low
bidder, Environmental Construction, Inc., submitted a base bid of $5,588,277.00. The bid abstract for
this project is included as Attachment 1. This amount included items totaling $831,805.00 required for
the relocation of numerous facilities owned by Orange County Water District (OCWD). This would
have to be reimbursed to the City by the Orange County Water District. However, as the bid price for
the relocation is higher than estimated, the Orange County Water District elected to proceed with the
relocation work independent of City's project. Therefore, it is recommended that City Council reject all
bids and authorize staff to re -advertise the project excluding the OCWD items.
In order to avoid delaying the City's project, OCWD is procuring bids for relocation through emergency
procedures and expects to complete their work prior to the planned project implementation schedule.
ALTERNATIVES CONSIDERED:
One alternative to this recommendation is for City Council to award the contract as bid and delete the
bid items for the OCWD relocation via change order. Staff does not recommend this option as the
Contractor will expect partial payment on items removed from the contract.
FISCAL REVIEW:
There is no fiscal impact at this time if all bids are rejected and the project is re -advertised as
recommended.
Construction funding for this project in the amount of $4,695,447.00 is available through a
combination of Measure "M2" Grant, OCFG's contributions, Drainage Fees, and Capital
Improvements Fund.
LEGAL REVIEW:
California Public Contract Code Section 20166 allows the legislative body, at its discretion, to
reject any and all bids presented and to re -advertise the project.
CONCLUSION:
It is recommended that the City Council reject all bids; and authorize staff to re -advertise the
project.
