Adopt plans, specifications, and working details for the Mace Avenue Alley (Alley No. 36), 19' Street Alley (Alley No. 70), Flower Street Alleys (Alley No. 77, Alley No. 78, and Alley No. 79), and Broadway Street Alleys (Alley No. 85, Alley No. 86, and Alley No. 88) Improvement Project - City Project No. 16-03. 2. Award a construction contract to Black Rock Construction Company, 615 N. Berry Street, Unit G, Brea, CA 92821, in the amount of $899,996.00. 3. Authorize the Mayor and the City Clerk to execute the Public Works Agreement. 4. Approve Contract Change Order No.1 in the amount of $305,000.00, and authorize the City Manager to execute the Change Order. BACKGROUND: The City owns and maintains 129 alleys. On November 20, 2007, a Citywide Alley Improvement Report was presented to the City Council. At that meeting, the Council approved a City Alley Improvement Priority List to address the City's alley system beginning with those alleys most in need of improvements. Over the past ten years, 76 alleys were reconstructed. This project includes rehabilitation of the following eight additional alleys: 1. Mace Avenue Alley (Alley No. 36) located between Mace Avenue and Ginger Avenue, from Caraway Drive to Wintergreen Place. 2. 19th Street Alley (Alley No. 70) located between 19th Street and Flower Street, from Orange Avenue to Westminster Avenue. 3. Flower Street Alley (Alley No. 77) located between Flower Street and Broadway, from Orange Avenue to Fullerton Avenue. 4. Flower Street Alley (Alley No. 78) located between Flower Street and Broadway, from Orange Avenue to Westminster Avenue. 5. Flower Street Alley (Alley No. 79) located between Flower Street and Broadway, from Westminster Avenue to Santa Ana Avenue. 6. Broadway Alley (Alley No. 85) located between Broadway and Magnolia Street, from Orange Avenue to Westminster Avenue. 7. Broadway Alley (Alley No. 86) located between Broadway and Magnolia Street, from Westminster Avenue to Santa Ana Avenue. 8. Broadway Alley (Alley No. 88) located between Broadway and Magnolia Street, from Raymond Avenue to Tustin Avenue. A Location Map has been included as Attachment 1. ANALYSIS: The alley rehabilitation process for the Mace Avenue Alley, 19th Street Alley, Flower Street Alleys, and Broadway Alleys consists of removal of deteriorated asphalt concrete alley sections and construction of new Portland Cement Concrete (PCC) pavement sections, adjustment of water and sewer utilities to grade, and other incidental work needed to transition between new and existing improvements. The City Clerk received and opened five (5) bids for this project on May 23, 2017. Black Rock Construction was the apparent low bidder with a bid proposal of $899,996.00. The Engineer's estimate was $1,082,530.00; and the average of the five (5) bids received amounted to $1,116,242.20. The Bid Abstract is included as Attachment 2. Analysis of the bids indicates the apparent low bidder submitted a bid proposal that is 17% lower than the Engineer's estimate. The variance between the low bidder and the Engineer's estimate may be attributed to the competitive conditions prevalent in the roadway construction industry at this time. Change Order No. 1 in the amount of $305,000.00 is being requested to utilize the competitive bid unit prices to add Sterling Avenue Alleys (Alley No. 12 and Alley No. 14) to this contract. Change Order No. 1 is included as Attachment 3. The license and references of Black Rock Construction Company were checked and staff has found them to be in good standing. Black Rock Construction Company has successfully completed other City projects, including the rehabilitation of several alleys. ALTERNATIVES CONSIDERED: The alternative to this Council action would be to reject all the bids. If all the bids are rejected, the City would need to readvertise the project. Staff believes that readvertising the project will not result in lower bids. FISCAL REVIEW: This project is funded from appropriated Gas Tax and Capital Improvement funds from prior fiscal year allocations and Fiscal Year 2017-2018. LEGAL REVIEW: Black Rock Construction has furnished the necessary bonds and insurance, which were approved as to form by the City Attorney. After the award and subsequent execution of the contract, a "Notice to Proceed" will be issued. Ir CONCLUSION: The advertisement and bid opening for the Mace Avenue Alley (Alley No. 36), 19th Street Alley (Alley No. 70), Flower Street Alleys (Nos. 77, 78, 79), and Broadway Street Alleys (Nos. 85, 86, 88) Rehabilitation Project - City Project No. 16-03, has been completed. It is recommended that the City Council adopt the plans, specifications, and working details for said project; award the contract to the apparent low bidder, Black Rock Construction Company, in the amount of $899,996.00; authorize the Mayor and the City Clerk to execute the Public Works Agreement; approve Contract Change Order No.1 in the amount of $305,000.00 towards construction of two additional alleys, and authorize the City Manager to execute the Change Order. EXTRA WORK AT CONTRACT PRICES Remove existing asphalt concrete alley sections and construct a new, 6 -inch section of 4,000psi Portland cement concrete with Buckeye Ultra Fiber 500 over compacted native soil. Change Order funds will be utilized to improve Sterling Avenue Alleys: Alley No. 12, located between Pomona Avenue and Wallace Avenue, from Sterling Avenue to W 20th Street, and Alley No. 14, located between Pomona Avenue and Wallace Avenue, from West 201h Street to West 19th Street.
