Adopt a Resolution for the submittal of a grant application to the California Department of Parks and Recreation, Outdoor Environmental Education Facilities Grant Program for the Fairview Park Native Habitat Nursery Project (Attachment 2). 3. Authorize the Public Services Director as the City's authorized representative. BACKGROUND: The Habitat Conservation Fund Program allocates approximately $2 million each year for grants to cities, counties, and districts to provide for nature interpretation and other non -capital outlay programs which bring urban residents into park and wildlife areas, to protect various plant and animal species, or to acquire or develop wildlife corridors and trails. Funds for this competitive grant program are derived from the State General Fund. The grant requires a minimum of fifty percent (50%) local match funds. The California Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Act of 2002 is intended to acquire and develop properties of the state park system, to acquire and develop neighborhood, community, regional parks, and recreational areas for land, air, and water conservation programs, including acquisition for those purposes, and to acquire, restore, preserve, and interpret California's historical and cultural resources. The Outdoor Environmental Education Facilities Grant Program allocates grants to cities, counties, and districts to provide public outdoor exhibits that facilitate focused learning. The focused learning must take place in a natural outdoor setting with native vegetation. The learning must encompass the natural environment, and inspire environmental stewardship and an appreciation of the natural world. ANALYSIS: The Habitat Conservation Fund provides grant funds to enhance or restore native habitat and enhance, restore, or develop trails. Competitive grant applications for the State's Habitat Conservation Fund Program are due on October 1, 2017. The grant application to the California Department of Parks and Recreation will request funding of $150,000 for the Fairview Park Vernal Pool Restoration Project. The project includes the eradication of non-native plants in the vernal pools, restoration of the native plant material, and educational signage. The total project cost is estimated at $300,000. If grant funding is approved, construction may begin in the summer of 2018. To apply for these grant funds a resolution approving the filing of an application and designation of the Public Services Director as the City's authorized representative is needed. The Outdoor Environmental Education Facilities Grant Program allocates grants to cities, counties, and districts to provide public outdoor exhibits that facilitate focused learning. The focused learning must take place in a natural outdoor setting, with native vegetation. The learning must encompass the natural environment and inspire environmental stewardship and an appreciation of the natural world. Competitive grant applications for the State's Habitat Conservation Fund Program are due on September 1, 2017. The grant application to the California Department of Parks and Recreation will request funding of $250,000 for the Fairview Park Native Habitat Nursery Project. The project includes the erection of an outdoor native plant nursery, signage and equipment. The total project cost is estimated at $275,000. If grant funding is approved, staff will present the project to the Fairview Park Steering Committee for review prior to implementation. To apply for these grant funds a resolution approving the filing of an application and designation of the Public Services Director as the City's authorized representative is needed. ALTERNATIVES CONSIDERED: Council may consider not adopting the Resolutions. However, this alternative is not recommended as it would result in the City's project applications being declined and render the City ineligible to compete for available grant funding. FISCAL REVIEW: The total construction cost for the Habitat Conservation Fund project is estimated at $300,000. If staff is successful in capturing grant funding for this project, a $150,000 match is required for this grant program. The needed funding match will come from the City's FY 2018-19 funding allocations for Fairview Park. The total construction cost for the Outdoor Environmental Education Facilities project is estimated at $275,000. A match for this grant is not required but the City will commit $25,000 of FY 2018-19 funding allocations for Fairview Park, which will earn bonus points in the scoring of the application. LEGAL REVIEW: The City Attorney has reviewed and approved the Resolutions as to form. CONCLUSION: It is recommended that the City Council adopt the attached Resolutions for the filing of a grant application to the California Department of Parks and Recreation, Habitat Conservation Fund Program for the Fairview Park Vernal Pool Restoration Project and a grant application to the California Department of Parks and Recreation, Outdoor Environmental Education Facilities Grant Program for the Fairview Park Native Habitat Nursery Project and designate the Public Services Director as the City's authorized representative. RAJA SETHURAMAN BALTAZAR MEJIA Public Services Director City Engineer ATTACHMENTS: 1 - Proposed Habitat Conservation Fund Resolution 2 - Proposed Outdoor Environmental Education Facilities Resolution ATTACHMENT 1 Resolution No: RESOLUTION OF THE COSTA MESA CITY COUNCIL APPROVING THE APPLICATION FOR GRANT FUNDS FROM THE HABITAT CONSERVATION FUND PROGRAM WHEREAS, the people of the State of California have enacted the California Wildlife Protection Act of 1990, which provides funds to the State of California for grants to local agencies to acquire, enhance, restore or develop facilities for public recreation and fish and wildlife habitat protection purposes; and WHEREAS, the State Department of Parks and Recreation has been delegated the responsibility for the administration of the HCF Program, setting up necessary procedures governing project application under the HCF Program; and WHEREAS, said procedures established by the State Department of Parks and Recreation require the applicant to certify by resolution the approval of application(s) before submission of said application(s) to the State; and WHEREAS, the applicant will enter into a contract with the State of California to complete the project(s); NOW, THEREFORE, BE IT RESOLVED that the City Council of Costa Mesa hereby: SECTION 1. APPROVES: the filing of an application for the Habitat Conservation Fund Program; and certifies that said applicant has or will have available, prior to commencement of any work on the project included in this application, the required match and sufficient funds to complete the project; and certifies that the applicant has or will have sufficient funds to operate and maintain the project(s), and certifies that the applicant has reviewed, understands, and agrees to the provisions contained in the contract shown in the grant administration guide; and delegates the authority to the Public Services Director to conduct all negotiations, execute and submit all documents, including, but not limited to applications, agreements, amendments, payment requests and so on, which may be necessary for the completion of the project, and agrees to comply with all applicable federal, state and local laws, ordinances, rules, regulations and guidelines. SECTION 2. The City Clerk shall certify to the passage and adoption hereof. PASSED AND ADOPTED this 1 st day of August 2017.
