HomeMy WebLinkAbout07-32 - Approving Initial Study/Mitigated Negative Declaration for Susan St Exit Ramp (N/B I-405 Fwy)RESOLUTION NO. 07-32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING THE INITIAL STUDY/MITIGATED NEGATIVE DECLARATION FOR THE SUSAN STREET EXIT RAMP PROJECT FROM THE NORTHBOUND 1-405 FREEWAY. THE CITY COUNCIL OF THE CITY OF COSTA MESA HEREBY RESOLVES AS FOLLOWS: WHEREAS, Initial Study/Mitigated Negative Declaration (State Clearinghouse Number 20070111:28) has been prepared for the Susan Street Exit Ramp Project; and WHEREAS, the Initial Study/Mitigated Negative Declaration was prepared in accordance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the City of Costa Mesa Environmental Guidelines; and WHEREAS, the City of Costa Mesa circulated the Draft Initial Study/Mitigated Negative Declaration from January 29, 2007, to February 27, 2007, for public comment and review; and WHEREAS, the City staff conducted a public open house on February 15, 2007, on the Draft Initial Study/Mitigated Negative Declaration; and WHEREAS, the City of Costa Mesa received written and verbal comments from the public during and after the review period; and WHEREAS, written comments and oral testimony were responded to in the manner set forth in California Code of Regulations Section 15088(b) through Comments and Responses prepared by, the City of Costa Mesa; and WHEREAS, the Planning Commission conducted a public hearing on March 12, 2007, on the Initial Study/Mitigated Negative Declaration and recommended its approval to the City Council; and WHEREAS, the City Council conducted a public hearing on March 20, 2007, on the Draft Initial Study/Mitigated Negative Declaration; and WHEREAS, the City Council has reviewed all environmental documents comprising the Initial Study/Mitigated Negative Declaration and has found that the Initial Study/Mitigated Negative Declaration considers all environmental impacts of the proposed project and is complete and adequate and fully complies with all requirements of CEQA, the CEQA Guidelines, and the City of Costa Mesa Environmental Guidelines; and WHEREAS, the Initial Study/Mitigated Negative Declaration reflects the independent judgment of the City of Costa Mesa. NOW THEREFORE, BE IT RESOLVED that the Costa Mesa City Council does hereby approve the Initial Study/Mitigated Negative Declaration as complete and adequate in that it addresses all environmental effects on the project and fully complies with the requirements of CEQA, the CEQA Guidelines, and the City of Costa Mesa Environmental Guidelines.
