A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA,
ESTABLISHING AND ADOPTING SCHEDULES OF SPECIAL EVENT RATES FOR
SWORN PERSONNEL FOR FISCAL YEAR 2018-2019 FOR SERVICES PROVIDED BY
THE CITY OF COSTA MESA
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, the City Council of the City of Costa Mesa has heretofore
established various schedules of rates, fees, and charges for services provided by the
City including, but not limited to, rates, fees, and charges for the rental of facilities,
building permits, public services, and public safety; and
WHEREAS, pursuant to the provisions of the California Constitution and the laws
of the State of California, the City of Costa Mesa is authorized to adopt and implement
rates, fees, and charges for municipal services; provided, however, that such rates,
fees, and/or charges do not exceed the estimated reasonable cost of providing such
services; and
WHEREAS, California Government Code Section 66016 requires notice to be
given and data made available at specified times. prior to the adoption of increases in
existing rates, fees, and charges, or the adoption of new rates, fees, and charges for
use permits and building inspections sometime hereinafter at a public meeting of this
City Council; and
WHEREAS, California Government Code Section 66018 requires notice to be
published in accordance with California Government Code Section 6062a and data
made available concerning rates, fees, and charges prior to conducting a public hearing
with respect to the adoption of increases in rates, fees, and charges, or the adoption of

new rates, fees, and charges for which no other procedure is provided by law; and
WHEREAS, pursuant to California Government Code Section 66016, this City
Council has held at least one public hearing and received oral and written presentations
thereat with respect to "user fees" prior to the adoption of this Resolution; and
WHEREAS, pursuant to California Government Code Section 66018, this City
Council has conducted and concluded a duly noticed public hearing with respect to the
rates, fees, and charges prior to the adoption of this Resolution; and
WHEREAS, this City Council desires to adjust the rates, fees and charges, and
to implement new rates, fees, and charges for various government services provided
by the City of Costa Mesa as set forth herein; and
WHEREAS, all legal prerequisites to the adoption of this Resolution have
occurred;
NOW, THEREFORE, BE IT RESOLVED as follows:
Section 1: This City Council hereby finds and determines that based upon
the data, information, analysis, oral and written documentation presented to this
City Council concerning the sworn personnel rates described in Exhibit "A" attached
hereto and by this reference incorporated herein, the sworn personnel rates set
forth in said Exhibit "A" do not exceed the established reasonable cost of providing the
service for which the rates are levied.
Section 2: The sworn personnel rates set forth in Exhibit "A" as further
described below, are hereby adopted and approved as the rates for the services
identified for each such rate:

Section 3: The sworn personnel rates set forth in Exhibit "A" shall be effective

and shall be implemented commencing July 1, 2018.
Section 4: Immediately upon the effective date of the rates set forth in Exhibit
"A", any previously established sworn personnel rates shall be, and the same are
hereby superseded by the sworn personnel rates established in said Exhibit "A".
Section 5 : The City Clerk shall certify to the adoption of the Resolution.

SUBJECT: SPECIAL, EVENT RATE FEE INCREASE. PROPOSAL
The City's financial policy is that fees will normally be set at full cost recovery. The
City's current special event rates for safety positions are less than full cost
recovery. Staff recommends the approval of the special event rates for sworn
personnel as listed in Attachment A.
BACKGROUND
As set forth under Administrative Regulation 2.13, City Staff annually determines
personnel rate charges to users for both special and .non -special events. Those
rates are then approved by the City Manager.
Based on Council Direction in July 2011, rates for Police and Fire sworn positions
are set at less than full cost recovery using the reasoning, that with lower rates,
perhaps more special events would be scheduled, thus increasing the overall City
revenue from these rates. Full cost recovery is used for non -sworn rates.
The FY 17-18 special event rates, Attachment B, for both sworn and non -sworn
positions were approved by the City Manager on July 26, 2017, and were updated
in November 2017 to include the new MOU with the Costa Mesa Firefighters
Association.
During the June 6, 2017 Council meeting, when the traffic management service
agreements with OC Fair were approved, Council directed the Finance Department
to look at full cost recovery for rates Citywide.
ANALYSIS AND FISCAL REVIEW
Historically the City's special event rate calculation methodology has been based on
the following, assumption for non -sworn employees:
• Top step hourly rate using 1,800 of productive hours
• Workers' compensation insurance
• Retirement
• Cafeteria plan
• Medicare
• Direct and indirect City overhead
• Special Event Rate increases the salary and other compensation hourly rate by
50 percent
This methodology is modified for sworn Police and Fire safety positions. Top step
hourly rate is based on a total of 2,080 available hours and excludes direct and indirect
City overhead.
Staff completed a survey in late 2017 to compare special event rates to neighboring
cities as set out in the chart below. The survey revealed that at that time, only Newport
Beach included overhead costs and recovered at full cost. This is consistent with what
Staff is recommending now.

The potential annual'' revenue increase of $304,246 is based on projected FY 2017-
2018 level of billing activity. In order to achieve full cost recovery, staff recommends
calculating sworn personnel rates using the same method used for non -sworn
personnel, which would revise the base annual top step rate on 1,800 vs. 2,080
available hours and add direct and indirect City overhead.
