HomeMy WebLinkAbout290 - Prohibiting the Sale and Regulating the Use of FireworksORDINANCE NO. 290 AN ORDINANCE OF THE CITY OF COSTA MESA PROHIBITING THE SALE AND REGULATING THE USE OF FIREWORKS WITHIN THE CITY. The people of the City of Costa Mesa do ordain as follows: SECTION 1. The word "Fireworks" as used in this Ordinance shall mean and include the definition thereof set forth in Section 12.01 of Article 12 of the Fire Prevention Code recommended by the National Board of Fire Underwriters, as amended and as said Section of said Code shall hereafter be amended. SECTION 2. Except as hereinafter provided it shall be unlawful for any person to offer for sale, expose for sale, sell at retail, or use or explode any fireworks; provided that the Chief of the Fire Department, with the approval of the City Council, shall have power to adopt reasonable rules and regulations for the granting of permits for supervised public .displays of fireworks by the municipality, fair associations, amusement parks, and other organizations. Every such display shall be handled by a competent operator approved by the Chiefs of the Fire and Police Departments, and shall be of such a character, and so located, discharged or fired as in the opinion of the Chief of the Fire Department, after proper inspection, shall not be hazardous to property or endanger any person. SECTION 3. This Ordinance shall be in full force and effect ten (10) days after the Canvassing Board of the City of Costa Mesa finds and determines that it was adopted by a majority of the electors of the City of Costa Mesa, voting thereon at the general municipal election held on the 12th day of April, 1960.
