HomeMy WebLinkAbout320 - Off Street ParkingORDINANCE NO. 320 AN ORDINANCE OF THE CITY OF COSTA MESA ESTABLISHING CERTAIN REt'xULATIONS PERTAINING TO THE REt$JIREMEATS OF OFF-STREET PARKING FOR ALL USES OF LAND INCLUDING BUT NOT LIMITED TO ALL THOSE USES SET FORTH WITHIN ORDINANCE NO. 319 (COMPREHENSIVE ZONING ORDINANCE) PRESCRIBING AND DESCRIBING CERTAIN STANDARDS, MAPS, CHARTS AND DIAGRAMS AS SET FORTH ON DRAWINGS, PROVIDING FOR AMENRI@M, ADJUS51HWS AND ENFORCE- MENTS, PRESCRIBING PENALTIES FOR ITS VIOLATION AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. The City Council of the City of Costa Mesa does hereby ordain as.follows: SECTION 1. Article 3 of Chapter TK of the Municipal Code of the City of Costa Mesa is hereby added to read as follows: CHAPTER IX LAND USE ARTICLE 3 Off-street Parking DIVISION I Declaration of Intent and Purpose Sec. 9310.1 Intent and Purpose of Ordinance. An official off-street parking plan of the City of Costa Mesa is hereby adopted and established to serve the public health, safety and general welfare resulting from an off-street parking requirement. Sec. 9310.2 Name of Ordinance. This ordinance shall be known as the Comprehensive Parking Ordinance of the City of Costa Mesa. DIVISION II Definitions Sec. 9320.1 General Terminology. When not inconsistent with the context, words used in the singular number includes the plural and those in the plural include the singular; words used in the present tense include the future. Sec. 9320.2 The word "shall" is mandatory and word "may" is permissive. Sec. 9320.3 The word "Council" shall mean the City Council of the City of Costa Mesa. Sec. 9320.4 The word "Commission" shall mean any commission of the City of Costa Mesa, specifically designated. Where not specifically designated, it shall mean the Planning Commission of the City of Costa Mesa. Sec. 9320.5 The word "Department" shall mean any department of the City of Costa Mesa specifically designated. Where no department is specified, it shall mean the Planning Department. Sec. 9320.6 The word "City" shall mean the City of Costa Mesa, California. Sec. 9320.7 The word "Amendment" shall mean a change in the wording or context of substance of this Ordinance, or a change in the descriptive maps, charts or diagrams which are a part of this Ordinance when adopted by Ordinance and passed by the Council in a manner prescribed by law. DIVISION III General Provisions Sec. 9330.1 Automobile Parking Space. Shall mean a usable space as set forth in this ordinance, and/or shown on the standards made a part of this ordinance. Sec. 9330.2 Lot, Parking. Shall mean that portion of a building site (s) designated for the parking of automobiles whether public or private, improved with macadam surfacing or equal. Sec. 9330.3 Ingress. Shall mean that portion or portions of the building site abutting a dedicated street or alley used or intended to be used for access to a parking area. Sec. 9330.4 Egress. Shall mean that portion or portions of the building site abutting a dedicated street or alley used or intended to be used for the entering on to a public street or alley. Sec. 9330.5 Vehicle Parking District. Shall mean a designated area acquired as provided by law and used or intended to be used as common parking facilities for a specified area. Sec. 9330.6 Residential. Shall mean those several uses as defined in the Comprehensive Zoning Ordinance of the City of Costa Mesa. Sec. 9330.7 Commercial. Shall mean those several uses as defined in the Comprehensive Zoning Ordinance of the City of Costa Mesa. -2- Sec. 9330.8 Professional. Shall mean those several uses as defined or set forth in the Comprehensive Zoning Ordinance of the City of Costa Mesa. Sec. 9330.9 Industrial. Shall mean those several uses as defined or set forth in the Comprehensive Zoning Ordinance of the City of Costa Mesa. Sec. 9330.10 City Standards. Shall mean those certain charts, diagrams, maps adopted by the City Council either by reference or specific designation and by this adoption are made a part of this Ordinance. DIVISION IV Establishing of Certain Zones or Districts Sec. 9340.1 Overlay Zones. Recognizing that the same basic uses under different circumstances may require more or less off-street parking facilities and/or spaces, the Council may, after study from time to time, adopt certain zones or districts as set forth on a map made a part of this ordinance, which by conditions created in this given district, may require a greater or lesser number of required automobile parking spaces. Said zones shall be known as overlay zones. Sec. 9340.2 Special District Boundaries. When the City Council determines after study that a certain area may require a greater or lesser amount of off-street automobile parking spaces and said district is adopted as prescribed by law, the boundaries of said district shall be clearly designated upon the official zoning map of the City of Costa Mesa. In all cases when a special district is adopted, the Planning Department shall cause to have prepared, a Master District Map drawn on linen cloth in ink clearly showing said special district boundaries. DIVISION V Residential Parking Requirements Sec. 9350.1 Two Off -Street Parking Spaces. When a building site is used exclusively for residential purposes, each living unit constructed upon the site shall provide two (2) usable off-street parking spaces. -3- Sec. 9350.1 Cont. Provided further, where said spaces are to be located in the front one-half (1/2) of the site, or in any event plainly visible from the street designated as the front for building purposes, said spaces shall be enclosed or so designed as not to be visible from said street. IjF said spaces are located upon the rear one-half (1/2) of the site, or in no way visible from the street, no enclosure shall be required. Sec. 9350.2 Residential -Combination Use. When a building site is used for a combination of residential and pro- fessional, commercial or other use, and uses are clearly not in conflict with each other, overlapping parking may be permitted when such uses or proposed uses are approved by the Planning Commission of the City of Costa Mesa or its delegated authority. DIVISION VI Administrative -Professional Parking Requirements Sec. 9360.0 Those uses designated as Administrative Professional uses in the Costa Mesa Zoning Ordinance shall provide parking as hereinafter shown. Sec. 9360.1 Residential Uses. As provided in Section 9350.1 and 9350.2• Sec. 9360.2 Administrative Offices. (Not otherwise specified) one space per each 200 square feet of gross building area. Sec. 9360.3 Attorneys -at -Law. One (1) space for each Attorney and/or secretary plus two (2) additional spaces. Sec. 9360.4 Accountants or Bookkeepers. Svace One (1)Afor each Accountant and secretary or clerk plus two (2) additional spaces. ',T Sec. 9360.5 Doctors -- General Practioners. One (1) space for each Doctor, nurse and/or receptionist plus three (3) additional spaces for each two examination rooms. (a) fraction of a required space shall mean a full space. -4- Sec. 9360.6 Doctors -- Specialists. One (1) space for each Doctor, nurse and/or receptionist plus one (1) additional space for each examination room. Sec. 9360.7 Dentist. One (1) space for each Dentist, nurse or receptionist plus three (3) additional spaces for each dental chair. Sec. 9360.8 Telephone Answering Service. One (1) space for each switchboard operator plus two (2) additional spaces. Sec. 9360.9 Exhibit Hall for Commercial or Industrial Exhibits. One (1) space for each two (2) persons said hall can accommodate up to 200 persons, one (1) additional space per each three (3) persons in excess of 200 as determined by the fire safety laws of the City of Costa Mesa. Sec. 9360.10 Other Cases. In all other cases no professional use shall be permitted with less than one (1) space for each 200 square feet of gross building area. DIVISION VII Commercial District Sec. 9370.1 CIS Shopping Center District. q Where an area is zoned tqI-S) in the Comprehensive Zoning Ordinance the off street parking ratio shall be not less than three (3) square feet of gross parking area to one (1) square foot of gross building area. Sec. 9370.2 Cl - C2 - C3 Commercial Districts. In the above named districts, parking shall be provided as follows: Sec. 9370.3.1 One space for each 200 square feet of gross floor area. Banks Department Stores Grocery Stores Bakeries Clothing Stores Drug Stores Meat Market Music Stores Shoe Stores Confectionary Stores Business Colleges Dancing & Music Academies Offsale liquor Stores Pool Hall Used Goods Sale (second hand) Appliance Repair Shop Sec. 9370.3.2 One space for each 300 square feet of gross floor area. -5- Sec. 9370.3.2 (Cont.) Dry Goods & Notion Stores Antique Stores Appliance Stores Art Shop & Galleries Auto Accessory Stores Book & Stationary Stores Credit Bureaus Dry Cleaning Shops Employment Agencies Florist & Gift Shops Hardware Stores Jewelry Stores Pawn Shops Small Animal Hospital Hospital Turkish Baths Auction Houses Loan & Mortgage Co. Luggage Shops News Stands Paint Stores Pet Shops Photographic Supplies Toy Shops Cleaning and/or Dyeing Plants Frozen Food, where customer served Launderies, Retail Newspaper Printing Locksmith Printing Shops Commercial Greenhouses, retail Tire Sales including repair & recap Heating & Vent. Equip. Sales Sec. 9370.3.3 One space for each 700 square feet of gross land area. Furniture Stores Auto Sales & Service Auto Trailer Sales Auto Sales Automatic Car Wash Auto Repair Garage Glass Cutting & Edging (including auto and mirror silvering) Milk Stores Nurseries, Retail Sec. 9370.3.4. Plumbing Supply, wholesale Electrical Supply, wholesale Upholstery Shop Ice Storage and Sales Storage Warehouse Super Service Station Body & Fender Shop Greenhouse, wholesale Heliport The following uses shall provide parking based upon the number of persons such use can accomodate as shown by capacity signs posted by the Costa Mesa Fire Department: A. 1 for 2 seats first 100 1 for 3 seats 101 to 300 1 for 4 seats 301 plus Cafe Restaurants On Sale Liquor, (including beer) Amusement Resorts Auction Houses Skating Rinks, ice or roller Church Auditoriums Bowling Alleys Theaters Drive-in Restaurants Gymnasiums (Public) Wedding Chapels Mortuary B. 3 spaces for each 2 chairs -- any fraction shall be considered a whole requirement. Barber Shops Beauty Shops C. Hotel ---- one for each room to 40 rooms one for each two (2) rooms from 41-80 rooms one for each three (3) rooms from 81 rooms on D. Motels one for each rentable unit Sec. 9370.3.4 (Cont.) E. Laundromats -- one space for each two machines F. In all other cases where a use is not listed above, the parking requirements shall be based upon: (a) If use is place where people congregate, parking shall be provided as set forth in Sec. 9370.3.4A. (b) In all other cases, parking shall be provided at one for each 200 sq. ft. of gross building area. DIVISION VIII Industrial District Sec. 9380.1 M I Districts Parking shall be provided as follows: A. Watchman quarters -- one for each guard on the largest shift B. One space for each 200 square feet of gross floor area Research Laboratories & Institutes Electrical and Electronic Products Instruments Manufacturing Paper Products Automobile Assembly Off Sale Liquor Establishments Machine Shops Cleaning & Dyeing Plants Garment Manufacturing Launderies Aircraft Sub -assembly Any use not specifically listed herein, unless otherwise approved by Planning Commission C. One space for each 300 square feet of gross floor area Building Material Cartography Bookbinding, printing & Lithography Plastic Products Fabrication Blacksmith Shop Boat Building Cabinet Shops Candy Factory Bottling Plants Creameries Ceramics (no outside displays) Concrete Pipe Furniture Manufacture of Finished Spices Lumber Yards Tire Recapping Welding Shops Sign Manufacturing Cold Storage Plants Ice Producing Plants Sheetmetal Shops Sash & Door Manufacturing Monumental Stone Works D. One space for each 700 square feet of gross land area Storage Warehouses Truck Terminals -7- SECTION 2. This Ordinance shall take effect and be in full force thirty (30) days from and after its passage, and prior to the expiration of fifteen (15) days from the passage thereof, this Ordinance,, together with the names of the members of the City Council voting for and against the same, shall be published once in the (LOBE -HERALD and PILOT, a newspaper of general circulation, printed and published in the City of Costa Mesa.
