HomeMy WebLinkAbout366 - Regulating the Issuance of Permits for Food Handling BusinessesORDINANCE NO. 366 AN ORDINANCE OF THE CITY OF COSTA MESA„ CALIFORNIA, REGULATING THE ISSUANCE OF PERMITS FOR FOOD HANDLING BUSINESSES. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES ORDAIN AS FOLLOWS: Section 1. There is hereby added to the Municipal Code of the City of Costa Mesa Article 5 of Chapter III as follows: AA'TTC" T R r, Food Handling Sec. 3501 Permits, It shall be unlawful for any person, firm or corporation owning, controlling or leasing,, acting as agent for, conducting, operating or managing any restaurant, cafe, lunch counter, cafe- teria, soda fountain, ice cream parlor, soft drink stand, fruit and vegetable stand, grocery, meat market, bakery, popcorn, peanut or other food vending stands or stations, food processing or manu- facturing plants, bottling plants, or other places or vehicles in the City of Costa Mesa where food is prepared for sale, sold, distributed, or displayed for sale, to conduct or operate, or cause or permit to be conducted or operated in said City of Costa Mesa such restaurant, cafe, lunch counter, cafeteria, soda fountain, ice cream parlor, soft drink stand, fruit and vegetable stand, grocery, meat market, bakery, popcorn, peanut or other food vending stands or stations, or food processing or manufacturing plants, bottling plants or other places or vehicles where food is prepared for sale, sold, distributed, or displayed for sale, or for any person to sell, or offer for sale, or cause or permit to be sold or offered for sale, any food or drink therein or therefrom without first applying for and receiving from the Health Department of the City of Costa Mesa a permit therefor. A permit for which application is made under the provisions of this ordinance, may be granted without charge at any time during -1- the year, but all permits granted hereunder shall expire con- currently with the city business license issued for the corres- ponding period. The permit shall be posted in a conspicuous place on the property. Sec. 3501.1 Where any such establishment as defined in Sec. 3501 in which any food product is prepared, manufactured or processed on or within the premises, is located in any market, pool or billiard hall, bowling alley, drug store, variety store, theatre or other place to which the public is admitted for purposes other than eating, it shall have a kitchen or food processing room that is fully partitioned off from that part of the building to which the public is admitted. All basic food preparation and processing shall be conducted within such room. This section shall not apply to soda fountains that serve only drinks and packaged foods. Sec. 3502 Exceptions. Provided, that this ordinance shall not apply to cigar stands or other places or vehicles of business where no food of any kind or nature is offered to sale or sold other than candy or soft drinks received in sealed packages, or boxes, or bottles where the seal or seals on said package or boxes are not broken prior to sale thereof, or vehicles engaged in the delivery of food products to retail establishments For resale. Sec. 3503 Inspection. It shall be lawful for any member or employee of the Health Department of the City of Costa Mesa to enter and go upon any pre- mises herein mentioned at any time for the purpose of inspecting the same and any member of the Health Department may require any person owning a permit under this ordinance to produce the same for inspection. If such inspection be refused the permit shall be forthwith revoked. Sec. 3504 Permit Suspension, -2- A permit which has been issued under the provisions of this ordinance may be temporarily suspended by the Health Officer upon violation by the holder of any State of local laws or ordinance pertaining to the purity of a food product or the sanitation of food handling establishments$ or revoked if the violation is not corrected after an appropriate notice of such violation has been served by the Health Officer, Section 2. This ordinance shall take effect and be in full force thirty (30) days from and after its passage, and prior to the expiration of fifteen (15) days from its passage shall be published once in the GLOBE -HERALD and PILOT, a news- paper of general circulation, printed and published in the City of Costa Mesa, together with the names of the members of the City Council voting for and against the same. crop AND ADOPTED this .j .ri day of cop h e , 1961.
