HomeMy WebLinkAbout413 - Pound Feesfollows: ORDINANCE NO. 413 AN ORDINANCE OF THE CITY OF COSTA MESA AMENDING SECTIONS 5124 AND 5137 OF THE MUNICIPAL CODE. The City Council of the City of Costa Mesa does hereby ordain as SECTION 1. Section 5124 of the Municipal Code of the City of Costa Mesa is hereby amended to read as follows: "Sec. 5124 Sale of Unredeemed Dog. If any dog or other domestic animal shall not be redeemed by the owner or keeper thereof, within the times hereinabove provided, then said dog or other domestic animal may be thereafter sold by the Poundmaster to any person having the ability to care for the same, who first complies with the terms of the Sections of this Article relative to the payment of cost of feed and care, plus the sun of $2.00 Pound fee, plus the payment of any required license tax." SECTION 2. Section 5137 of the Municipal Code of the City of Costa Mesa is hereby amended to read as follows: "Sec. 5137 Fees for Removal of Animals for Owners. The Poundmaster shall, upon request of any owner or possessor of any dog or other domestic animal, remove and dispose of such dog or other domestic aminal, and shall collect from such owner or possessor the sum of $2.00 for dog, or other small animal, and the sun of $5.00 for large animals, plus any actual cost incurred in such removal and disposal." SECTION 3. This Ordinance shall be effective immediately upon adoption as an urgency ordinance. The facts constituting the urgency are that the City of Costa Mesa contracts with the County of Orange for Pound Services at the rate established in said contract; that the County of Orange has, as of December 9, 1961, changed the fee from $1.00 to $2.00 for pickup and disposition of a dog or small animal and from $2.00 to $5.00 for a large animal; that it is necessary in order that the City not have a revenue loss to change its fees to accord with the rate changed by the County. SECTION 4. This ordinance shall take effect immediately, and within fifteen (15) days thereafter this ordinance, together with the names of the City Council voting for and against the same, shall be published once in the Orange Coast Daily Pilot, a newspaper printed in the City of Costa Mesa, California.
