A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, FOR FINDINGS AND DETERMINATION TO WAIVE THE BID PROCESS AND AUTHORIZE A SOLE SOURCE FOR COUNCIL CHAMBER WHEELCHAIR LIFT AND POLICE FACILITY ELEVATOR INSTALLATION AND HANDRAIL RETROFIT. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: 1. It is necessary to complete construction of a Council Chamber wheelchair lift and Police Facility elevator and handrail retrofit in order to comply with the Americans with Disabilities Act and California Title 24 Regulations. 2. The advertisement for competitive bids on June 5, 1995, resulted in one bid proposal for $199,264.00, which exceeded the City of Costa Mesa estimate and budget of $125,850.00 for the above -referenced project, and no other bidders appear to be available to bid on this project. 3. In regard to the above -referenced public works project, competitive proposals work an incongruity, are unavailing as affecting the final result, do not produce an advantage, and it is practically impossible to obtain what is required and to observe the form set forth in Public Contracts Code Section 20162. 4. The United States Department of Housing and Urban Development, the agency providing Community Development Block Grant funding for this project, has concurred with the proposed action to waive competitive bidding and negotiate a sole source contract for the above - referenced project and that competitive price bidding is not possible on the above -referenced project. I NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa, California, waives the bidding requirements for the construction of Council Chamber wheelchair lift and Police Facility elevator and handrail retrofit and authorizes the negotiation and award of a sole source contract for this project.
