HomeMy WebLinkAbout95-66 - Approving Planning Action PA-95-36a RESOLUTION NO. 95-- G A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING PLANNING ACTION PA -95-36 THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by Carolyn B. Stocker, authorized agent for Newport -Mesa Unified School District, with respect to real property located at 3100 Bear Street, requesting a Development Plan for a 79 -unit, small -lot, single-family residential development on the Bear Street School site located in the PDR -LD (pending) zone; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on July 10, 1995; and WHEREAS, by adoption of Planning Commission Resolution PC -95-41, the Planning Commission recommended approval of PA -95-36 for the Development Plan; and WHEREAS, the City Council held a duly noticed public hearing on August 7, 1995; NOW, THEREFORE, BE IT RESOLVED that, based on the evidence in the record and the findings contained in Exhibit "A", the City Council hereby approves Planning Action PA -95- 36 with respect to the property described above. The information presented substantially complies with Costa Mesa Municipal Code Section 13-253 in that the proposed development plan complies with the developed standards and density criteria of the PDR-I.,D zone, is compatible with the intent and spirit of the [.Manned development ordinance and applicable elements of. the General Plan and will enhance the health, safety, comfort, convenience and general welfare of the public in the neighborhood. Specifically, the proposed project will be compatible in design and appearance with the adjacent single-family residential neighborhood and will provide additional ownership, single-family housing opportunities to implement the primary policy direction in the Housing Element of the General Plan. B. All Initial Study WaS to the California Environmental Quality Act. Although the proposed project could have a significant effect on the environment, according to the Initial Study and Neyati.ve Declaration, which reflect the independent judgement of the City of Costa Mesa , there will not be a significant effect on the environment because mitigation measures have been added to the project. C. The evidence presented in the record as a whole indicates that the project will not individually or cumulatively have an adverse effect on wildlife resources or habitat. D. The project is consistent with Article 22 1/2, Transportation System Management, of Title 13, of the Costa Municipal Code in that the projected traffic generation from the project will not adversely impact the operation of affect intersections and will not cause any intersection to operate below the established acceptable level of service (LOS "D"). E. PA -95-36/ R-95-02/ T-15211 Ping. 1. Final building elevations shall be submitted to the Planning Commission for review and approval prior to the issuance of building permits. 2. Minor amendments to the approved Development Plan may be approved by the Development Services Director pursuant to the provisions of Section 13- 2.53 (6) of the Costa Mesa Municipal Code. Substantial amenciments shall be submitted as a new Development Plan. 3. Approval of the Planning Action is valid for one (1) year and will expire at the end of that period unless building permits are obtained or the applicant applies for and is granted an extension of time. 4. Address assignment shall be requested from the Planning Division prior to submittal of working drawings for plan check. The approved address of individual units, suites, buildings, etc., shall be blueprinted on the site plan and on all floor plans in the working drawings. 5. Prior to issuance of building permits, applicant shall contact the U..S. Postal Service with regard to location and design of mail delivery facilities. Such facilities shall be shown on the site plan, landscape plan, and/or floor plan. 6. Street address shall be displayed on the fascia adjacent to the main entrance or front door in a manner visible from the public street. Numerals shall be a minimum 6" in height with not less than 1/2" stroke and shall contrast sharply with the background. 7. Except as necessary for drainage, existing grades at property lines shall be maintained. 8. Demolition permits for existing structures shall be obtained and all work and inspections completed prior to final building inspections. Applicant is reminded that written notice to the Air Quality Management District may be required ten (10) days prior to demolition. 9. It is recommended that the applicant contact Continental Cable of Costa Mesa at 200 Paularino, Costa Mesa, (546-2946) prior to construction to arrange for pre -wiring for future cable communication service. APPL. PA -95-36/ R-95-02/ T-15211 10. The Conditions of Approval and Code Requirements of Planning Action PA -95-36 shall be blueprinted on the face of the site plan. 11. The applicant shall contact the Planning Division to arrange for a "Special Requirements" inspection of the site prior to the release of occupancy. This inspection is to confirm that the Conditions of Approval and Code Requirements have been satisfied. Eng. 12. Maintain the public right-of-way in a "wet -down" condition to the degree necessary to prevent excessive dust and periodically remove any spillage from the public right-of-way by sweeping or sprinkling. CODE REQUIREMENTS The following list of Federal, State, and local laws applicable to the project has been compiled by Staff for the applicant's reference. Any reference to "City" pertains to the City of Costa Mesa. Ping. 1. All contractors and subcontractors must have valid business licenses to do business in the City of Costa Mesa. Final inspections, final occupancy and utility releases will not be granted until all such licenses have been obtained. 2. Permits shall be obtained for all signs, including banners and advertising, according to the provisions of the Costa Mesa Sign Ordinance. 3. Included in the required CC&Rs shall be a provision permitting the installation of solar heating systems, subject to applicable zoning district requirements, the Uniform Building Code, and associated ordinances, and reasonable architectural review by the project's architectural review committee. 4. The CC&Rs shall include a provision as to use and maintenance of all guest parking spaces, driveways and common open space. 5. CC&Rs and articles of incorporation and bylaws for the Homeowners' Association shall be reviewed and approved by both the Planning Division and the State of California, Department of Real Estate (DRE), prior to recordation. CC&Rs shall include provisions as required in Costa Mesa Municipal Code Section 13-827 and 13-829, as well as applicable Conditions of Approval and Code Requirements. The applicant shall provide the Planning Division proof of review and approval of the CC&Rs by the DRE prior to recordation. A copy of the recorded CC&Rs APPL. PA -95-36/ R-95-02/ T-15211 shall be submitted to the Planning Division prior to release of utilities for the units. 6. All on-site utility services skull be installed underground. 7. Installation of all utility meters shall be performed in a manner so as to obscure the installation from view off the property. The installation shall be in a manner acceptable to the public utility and shall be in the form of a vault, wall cabinet, or wall box, under direction of the Planning Division. 8. Tour (4) sets of detailed landscape and irrigation plans shall be required as part of the project plan check review and approval process. Three (3) sets shall be provided to the representative Water Agency and one (1) set shall be submitted to the Planning Division for review. Plans shall be approved by the Water Agency with two (2) approved sets forwarded by the applicant to the Planning Division for final approval prior to issuance of building permits. 9. Two (2) sets of landscape and irrigation plans, approved by both the Water Agency and the Planning Division, shall be attached to two of the final building plan sets. 10. Landscape and irrigation plans shall meet the requirements set forth in Costa Mesa Municipal Code Sections 13-263 through 13-266 as well as irrigation requirements set forth by the Water Agency. Consult with the representative Water Agency Mesa Consolidated Water District, Ray Barela (714) 631-1291 for requirements. 11. Landscaping and irrigation shall be installed in accordance with the approved plans prior to final inspection or occupancy clearance. 12. Installation of minimum 6' high block walls shall be required between all residential lots. 13. All property line walls or fences shall be repaired or replaced as necessary under the.direction of the Planning Division. 14. In compliance with the provisions of the California Administrative Code, Title 25, Chapter 1, Subchapter 1, Article 4, the applicant shall submit an acoustical analysis of the proposed development, prepared under the supervision of a person experienced in the field of acoustical engineering. Two copies of the report shall be submitted with the application for building permits. The acoustical analysis shall evaluate existing and projected noise levels, noise attenuation measures to be applied, and the noise insulation APPL. PA -95-36/ R-95-02/ T-15211 effectiveness of the proposed construction. 'The person preparing the report shall, under the direction of a person experienced in the field of acoustical engineering, perform an inspection of the project prior to or at the time of the framing inspection to certify that construction techniques comply with recommendations contained within the acoustical analysis. Upon completion of the subject structures, field tests may be required under the provisions of 'Title 25. 15. In compliance with the City's Mitigation Monitoring Program, the applicant shall submit a compliance report to the Planning Division prior to issuance of building permits. The report shall list each mitigation measure and state when and how the mitigation measure is to be satisfied. Bldg. 16. Comply with the requirements of the Uniform Building Code as to design and construction, and CCR Title 24 pertaining to "Disabled Access Regulations". 17. Street trees shall be Pinus Canariensis on Bear Street and Tristania Conrerta on Paularino Avenue. Residential lots shall have at least one tree (species to be determined later), 15 -gallon minimum size. Eng. 18. At the time of develol)ment, submit for approval an Off-site Plan to the Enyineering Division and Grading Plan to the Building Division that shows sewer, water, existing parkway improvements and the limits of work on the site, and hydrology calculations, both prepared by a civil engineer or architect. Site access approval must be obtained prior to Building or Engineering Permits being issued by the City of Costa Mesa. Pay Offsite Plan Check Fee to the Engineering Division. An approved Offsite Plan and fee shall be required prior to Engineering/Utility Permits being issued by the City. 19. A Site Access Permit and deposit of $750 for street sweeping will be required by the Engineering Division prior to the -start of any on- or off-site work. 20. Haul routes must be approved by the Engineering Division, prior to approval of the Site Access Permit. 21. Submit for approval to the Engineering Division, street improvement plans, that show sewer and water improvements, prepared by a civil engineer, and fully improve the northerly one half of Paularino Avenue to its ultimate width per City of Costa Mesa Standards. APPL. PA -95-36/ R-95-02/ T-15211 22. Per Section 15-32 C.C.M.M.C. submit required cash deposit and/or surety bond to guarantee construction of offsite street improvements at time of permit. Cash Deposit or surety bond amount to be determined by City Engineer. 23. Obtain a.permit from the Engineering Division, at the time of development, and then construct P.C.C. residential sidewalk per City of Costa Mesa standards as shown on the offsite plan, including four (4) feet clear around obstructions in the sidewalk. 24. Obtain a permit from the Engineering Division, at the time of development and then construct P.C.C. driveway approach per City of Costa Mesa Standards as shown on the offsite plan. Location and dimensions are subject to the approval of the Transportation Services Manager. 25. Obtain a permit from the Engineering Division, at the time of development, and then remove any existing driveways and/or curb depressions that will not be used and replace with full height curb and sidewalk at applicant's expense. 26. Construct storm drain facilities as per City of Costa Mesa Master Drainage Plan. 27. Private on-site drainage facilities and parkway culverts or drains, will not be maintained by the City of Costa Mesa; they shall be maintained by the Tract Homeowner Association. Private lateral connections to City storm drains will require a Hold Harmless Agreement prior to issuance of permit. Trans. 28. Prior to issuance of building permits, dedicate all land 53 feet from the centerline of Bear Street and 40 feet from the centerline of Paularino Avenue for turn pocket. 29. Pay San Joaquin Hills Transportation Corridor Fee at the time of issuance of building permits by submitting the required fee to the Planning Division. At the current rate of.$2,302 per unit, the corridor fee is estimated to be $181,858.00. 30. Fulfill mitigation of off-site traffic impacts at the time of issuance of Certificate of Occupancy, by submitting to the Planning Division the required Traffic Impact Fee pursuant to the prevailing schedule adopted by the City Council. The Traffic Impact Fee is based upon the average daily trip generation rate of 10 trip ends per dwelling unit for the proposed single-family detached use, and includes a credit for any existing use. At the current rate of $200 per trip end, the Traffic Impact Fee is estimated to be $106,200.00. Fire APPL. PA -95-36/ R-95-02/ T-15211 31. Provide 7 Class A fire hydrants to be located as indicated on plans reviewed by the Fire Department. 32. All hydrants shall be installed and operable prior to initiation of combustible construction. 33. Water mains shall be of adequate size to deliver 1,000 gallons per minute simultaneously from the 7 closest hydrants to any and all points of the development with a minimum residual pressure of 20 psi. 34. Access consisting of a minimum 20 -foot wide roadway capable of supporting fire apparatus shall be maintained to all fire hydrants from the time that the hydrants are placed into service. Special consideration shall be given to maintaining the integrity of such roadways during periods of inclement weather. 35. Provide approved smoke detectors to be installed in accordance with the 1991 Edition of the Uniform Fire Code. 36. Provide "Blue Dot" reflective markers for all on- site fire hydrants. 37. Emergency access shall have rolled curbs at entrance and exit. SPECIAL DISTRICT REQUIREMENTS The requirements of the following special districts are hereby forwarded to the applicant: Sani. 1. Developer will be required to construct sewers to serve this project, at his own expense, meeting approval of the Costa Mesa Sanitary District. 2. County Sanitation District fees, fixture fees, inspection feAs, and sewer permit required prior to installation of sewer. To receive credit for buildings to be demolished, call 754-5307 for inspection 3. Developer shall submit a plan showing sewer improvements to the Costa Mesa Sanitary District Engineer's Office - 631-1731. 4. Developer shall contact the Costa Mesa Sanitary District at 754-5307 for trash collection requirements or exemptions for this project.
