HomeMy WebLinkAbout95-60 - Denying Planning Action PA-95-23RESOLUTION NO. S- 4 D A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DENYING PLANNING ACTION PA -95-23. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by Nancy Clark, authorized agent for Michael Cherney, with respect to real property located at 1110 Victoria Street, requesting a Conditional Use Permit for a residential facility for adult men and women recovering from drug or alcohol dependency in an existing apartment building, and a variance from covered parking requirements in an R3 zone; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on April 10, 1995; and WHEREAS, this application was called up for Council review by Council Member Sandra Genis on April 11, 1995; and WHEREAS, the City Council held a duly noticed public hearing on May 1, 1995, and denied Planning Action PA -95-23; and WHEREAS, the City Council voted 5-0 to conduct a rehearing of Planning Action PA -95-23 at the request of the authorized agent; and WHEREAS, the City Council held a duly noticed public hearing on July 5, 1995; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and the findings contained in Exhibit "A", the City Council hereby denies Planning Action PA -95-23 with respect to the property described above. PASSED AND ADOPTED this 5th day of July, 1995. The information presented does not substantially comply with Section 13-346 of the Costa Mesa Municipal Code in that no special circumstances applicable to the property exist to justify granting of the variance from parking. Strict application of the zoning ordinance will not deprive the property owner of privileges enjoyed by owners of other property in the vicinity under the identical zoning classification. B. The information presented does not substantially comply with Costa Mesa Municipal Code Section 13-347 in that the proposed residential facility is not substantially compatible with other developments in the same general area due to the intensity of the use which has resulted in disturbances to neighboring residents, and due to inadequate on-site parking and inadequate monitoring of residents. C. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. D. The project is exempt from Article 22-1/2, Transportation System Management of Title 13 of the Costa Mesa Municipal Code.
