A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA, REQUESTING THE
ORANGE COUNTY TRANSPORTATION AUTHORITY TO
ALLOCATE MEASURE M FUNDS FOR CONSTRUCTION
OF STATE ROUTE 55/STATE ROUTE 73 CONNECTOR "D".
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE
AS FOLLOWS:
WHEREAS, the Orange County Transportation Authority approved a Measure M Street
and Roads Program for fiscal year 1993-94; and
WHEREAS, the program includes $731,500.00 in fiscal year 1994-95 for a regional
interchange improvement project at State Route 55/State Route 73 Connector "D"; and
WHEREAS, the City of Costa Mesa has adopted a General Plan Circulation Element
which does not preclude implementation of the Master Plan of Arterial Highways within its
jurisdiction; and
WHEREAS, the City of Costa Mesa awarded the contract for the project on June 19,
1995, for $1,264,277.50; and the City of Costa Mesa has completed the required preparatory
work in accordance with the standards required by the City and other affected jurisdictions
involved with said project;
NOW, THEREFORE, BE IT RESOLVED that the City of Costa Mesa hereby requests
that the Orange County Local Transportation Authority allocate $568,924.88 of Measure M
funds from the Regional Interchange Program for construction of the State Route 55/State Route
73 Connector "D" Project to the City. This request is in conformance with the Measure M
allocation process and does not exceed ninety (90%) percent of the programmed amount or
ninety (90%) percent of the construction services contract.
BE IT FURTHER RESOLVED that the City of Costa Mesa agrees to fund any additional
costs over the identified programmed Measure M dollars.
BE IT FURTHER RESOLVED that the remaining ten (10%) percent of Measure M
funds will be transferred to the City of Costa Mesa when construction is completed and a final
report on the project is accepted by the Orange County Transportation Authority. The City of
Costa Mesa agrees to submit the final report to the Orange County Transportation Authority
within ninety (90) days after the City's acceptance of the improvements.
