HomeMy WebLinkAbout95-37 - OC Board of Supervisors Designate CM Fire Department as Administering Agency for Health & Safety CodeRESOLUTION NO. 95— 37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, REQUESTING THAT THE ORANGE COUNTY BOARD OF SUPERVISORS DESIGNATE THE COSTA MESA FIRE DEPARTMENT AS THE ADMINISTERING AGENCY FOR HEALTH AND SAFETY CODE, CHAPTER 6.95 (HAZARDOUS MATERIALS DISCLOSURE AND RISK MANAGEMENT AND PREVENTION). THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the State Legislature adopted statewide requirements for hazardous material inventory reporting and release planning in 1985 when AB 2185 added Chapter 6.95 to Division 20 of the Health and Safety Code; and WHEREAS, the purpose of AB 2185 was to require facilities to report inventories of regulated hazardous materials onsite to inform emergency response agencies of the potential hazards in responding to emergencies at such sites and/or to provide the public with information about neighboring facilities that pose potential hazards to community health and safety (public "right to know"); and WHEREAS, in 1986 the legislature, partially in response to the toxic gas disaster in Bhopal, India, adopted further legislation expanding AB 2185 to cover materials that can produce toxic clouds after fires, explosions, or other accidents (AB 3777 codified as Article 2 of Chapter 6.95 of the Health and Safety Code); and WHEREAS, the Costa Mesa Fire Department is the first responder to businesses that store or use hazardous materials within the boundaries of the City of Costa Mesa and, therefore, the agency whose personnel are the most likely to be exposed to such hazardous materials during emergency responses; and WHEREAS, the Costa Mesa Fire Department has a need to access information concerning hazardous materials immediately during emergency responses; and WHEREAS, the Costa Mesa Fire Department is the agency with responsibility for enforcement of hazardous materials regulations contained in the Uniform Fire Code; and WHEREAS, AB 2185 allows cities to become administering agencies within their boundaries only with the agreement of their country; and WHEREAS, the Orange County Fire Authority has agreed to assist and cooperate with the Costa Mesa Fire Department in the transfer of the responsibility of administering Health and Safety Code, Chapter 6.95 within the City of Costa Mesa; and WHEREAS, it is in the best interest of the health, safety and welfare of the citizens of Costa Mesa and personnel of the Costa Mesa Fire Department; and WHEREAS, the Orange County Fire Authority is the agency currently designated as the administrating agency for Health and Safety Code, Chapter 6.95 within the City of Costa Mesa; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: That the City Council of the City of Costa Mesa does hereby request that the Orange County Board of Supervisors designate the Costa Mesa Fire Department as the Administering Agency for Health and Safety Code, Chapter 6.95 (Hazardous Materials Disclosure and Risk Management and Prevention) within the city limits of the City of Costa Mesa.
