A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA, DENYING
PLANNING ACTION PA -95-03.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, an application was filed by Steven Winnett, authorized agent for Ogle
Associates, with respect to real property located at 250 Ogle Street, requesting a Conditional Use
Permit to allow eight storage containers to remain at the Hi Time Cellars property in a Cl zone;
and
WHEREAS, a duly noticed public hearing was held by the Planning Commission on
February 13, 1995; and
WHEREAS, on February 16, 1995, an interested party filed an appeal of the Planning
Commission decision; and
WHEREAS, the City Council held a duly noticed public hearing on March 20, 1995;
NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record, and
the findings contained in Exhibit "A", the City Council hereby DENIES Planning
Action PA -95-03 with respect to the property described above.
PASSED AND ADOPTED this 20th day of March, 1995.

PLANNING ACTION PA -95-03
FINDINGS
A. The information presented does not substantially comply with Costa Mesa Municipal
Code Section 13-347 in that the proposed use is not substantially compatible with existing
development in the same general area, and granting the Conditional Use Permit will be
detrimental to the health, safety, and general welfare of the public or other properties or
improvements within the immediate vicinity; and would provide the applicant with special
privileges not enjoyed by other businesses in the area.
