HomeMy WebLinkAbout95-12 - Approving Planning Action PA-95-02RESOLUTION NO. �5� ��-- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING PLANNING ACTION PA -95-02. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by the City of Costa Mesa on behalf of the property owners of 703, 706, 707, 711, 716, 717, 720, 721, 724, 730, 731, 734, 735, 740, and 745 Shalimar Drive; 702, 703, 706, 716, 717, 720, 721, 724, 730, 734, 735, 740, 741, and 744 James Street; and 703, 707, 711, 725, 731, and 745 West 18th Street, requesting variances from interior garage dimensions and garage door width dimensions in conjunction with legalizing the conversion of carports to garages and future proposals to convert carports to garages at the above addresses in the R3 zone; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on January 23, 1995; and WHEREAS, due to the lack of a majority decision by the Planning Commission on January 23, 1995, an appeal was filed by the City on behalf of the property owners; and WHEREAS, the City Council held a duly noticed public hearing on February 21, 1995; NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and findings contained in Exhibit "A", and subject to the conditions contained in Exhibit "B", the City Council hereby approves Planning Action PA -95-02 with respect to the properties listed above. BE IT FURTHER RESOLVED that the Costa Mesa City Council does hereby find and determine that adoption of this resolution is expressly predicated upon granting of the variances as described in the staff report for Planning Action PA -95-02, and upon applicants' compliance with each and all of the conditions contained in Exhibit "B". Should any material change occur, or should the applicants fail to comply with the Conditions of Approval, then this resolution, and any approvals herein contained, shall be deemed null and void. The information presented substantially complies with Section 13-346 of the Costa Mesa Municipal Code in that special circumstances applicable to the properties exist to justify granting the Variances from interior garage dimensions and garage door width dimension. Strict application of the zoning ordinance would deprive the property owners of privileges enjoyed by owners of other properties in the vicinity under identical zoning classification. Specifically, although a Police Department memo to Staff dated January 3, 1995, does not indicate an extremely high rate of crime and vandalism involving vehicles in the subject area, there appears to be a perception of danger and insecurity on the part of many property owners and residents. Staff feels that the use of Police bike patrol in the neighborhood is somewhat unique to this neighborhood and qualifies as a special circumstance for approving the Variances from interior garage dimensions and garage door width dimensions. B. The project has been reviewed for compliance with the Califor- nia Environmental Quality Act (CEQA), the CEQA Guidelines, and the City Environmental procedures, and has been found to be exempt from CEQA. C. The project is exempt from Article 22 1/2, Transportation System Management of Title 13, of the Costa Mesa Municipal Code. APPL. PA -95-02 EXHIBIT "B" CONDITIONS OF APPROVAL Ping.l. Permits shall be obtained for all existing garage conversions within 90 days of Planning Commission approval. 2. All submittals for permits must include legible, scaled drawings with dimensions. 3. All garages shall be used for vehicular parking only. 4. Individual partitions shall not be installed to separate the garage spaces. 5. Minimum interior single garage dimensions shall be as close to 10' wide by 20' deep as possible, but shall not be less than 7' 10" wide by 17' deep. 6. Any obstructions that would impede parking of vehicles in the garages shall not be permitted. 7. Approval of the Planning Action is valid for 1 year and will expire at the end of that period unless building permits are obtained or the applicant applies for and is granted an extension of time. 8. Property addresses shall be displayed along the alleys to aid emergency and other service vehicles in locating the properties from the alley. Address numerals shall be at lest 6" in height with not less than 1/2" stroke and shall contrast sharply with the background. 9. All carports that have been converted to storage units shall be restored to their original conditions within 90 days of Planning Commission approval. 10. All new carport conversions shall be equipped with double doors at least 16 feet wide, except in situations where there are odd numbered open carports. In that case, minimum single garage door widths shall be as close to 9 feet as possible, but shall not be less than 7 feet. CODE REQUIREMENTS The following list of Federal, State, and local laws applicable to the project has been compiled by Staff for the applicant's reference. Ping.l. All contractors and subcontractors must have valid business licenses to do business in the City of Costa Mesa. Final occupancy and utility releases will not be granted, and final inspections will not be granted until all such licenses have been obtained. Bldg.2. Comply with the requirements of the Uniform Building Code as to design and construction.
