HomeMy WebLinkAbout95-11 - "Bootstrap" Legislative Package in Connection with Orange County Financial CrisisRESOLUTION NO. q6-- l l A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, SETTING FORTH POLICY POSITIONS ON MEASURES PROPOSED BY THE ORANGE COUNTY BOARD OF SUPERVISORS AS PART OF ITS "BOOTSTRAP" LEGISLATIVE PACKAGE IN CONNECTION WITH THE ORANGE COUNTY FINANCIAL CRISIS. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AND FIND AS FOLLOWS: WHEREAS, on December 6, 1994, the County Board of Supervisors declared bankruptcy on behalf of the County of Orange and the Orange County Treasurer's Investment Pool; and WHEREAS, such declaration of bankruptcy places at risk the provision of basic services provided to all Orange County residents by the County, municipalities, school districts, and special districts; and WHEREAS, the declaration also impacts bond holders, private residents, and vendors delivering services to the County of Orange in the normal conduct of business; and WHEREAS, the County Board of Supervisors has called upon the Governor of the State of California to convene a special session of the State Legislature to deal with the Orange County financial crisis and to consider measures contained in the County's "Bootstrap" legislative package; and WHEREAS, provisions in the "Bootstrap" legislative package may adversely impact the residents and businesses in the City of Costa Mesa; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa hereby establishes the following policy positions on those measures contained in the County's "Bootstrap" legislative package. 1. The City of Costa Mesa shall support measures for relief of unfunded State mandates (except for crime mandates), requests for the State to remit to the County, municipalities, school districts, and special districts payment of all outstanding debts, waiver of the State Commission on mandates application process for a finding of "Significant Financial Distress" and State -mandated "Maintenance of Effort" provisions. 2. The City of Costa Mesa shall oppose measures that will allow the County of Orange to unilaterally change the terms of agreements entered into with other public agencies and private concerns, modify statutorily regulated restrictions on recovery of costs through fees assessed on the public and other governmental agencies, shift local revenues from cities, school districts, redevelopment agencies, and special districts to the County of Orange, impose new or increase fees on Orange County residents or businesses. 3. The City of Costa Mesa shall support full and open review and discussion, both in Sacramento and in Orange County, of the balance of those legislative measures contained in the County's "Bootstrap" legislative package. BE IT FURTHER RESOLVED that the Mayor of the City of Costa Mesa is hereby authorized to sign correspondence or offer oral testimony in support of the policy positions stated in this Resolution. BE IT FINALLY RESOLVED that the Deputy City Clerk is directed to transmit copies of this Resolution to all Orange County cities, the Board of Supervisors, and the Orange County legislative delegates.
