A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA, DENYING
PLANNING ACTION PA-95-40/REDEVELOPMENT ACTION
RA -95-04.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, an application was filed by Atari Corporation and Deborah Moch with
respect to real property located at 620 and 640 West 17th Street, requesting a Conditional Use
Permit (PA -95-40) to allow off-site parking for Empire Ballroom on the Staples parking lot
located at 620 West 17th Street, in a C2 zone, and Redevelopment Agency review (RA -95-04)
for off-site parking; and
WHEREAS, duly noticed public hearings were held by the Planning Commission
on July 24, 1995, August 14, 1995, August 28, 1995, and October 9, 1995; and
WHEREAS, the item was heard by the Costa Mesa Redevelopment Agency on
September 13, 1995; and
WHEREAS, the applicant filed an appeal of said Planning Commission and
Redevelopment Agency decisions on October 16, 1995; and
WHEREAS, the City Council held duly noticed public hearings on November 20, 1995,
and December 4, 1995;
NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and
the findings contained in Exhibit "A", the City Council hereby DENIES Planning
Action PA-95-40/Redevelopment Action RA -95-04 with respect to the property described
above.
PASSED AND ADOPTED this 4th day of December, 1995.

EXHIBIT "A"
FINDINGS
A. The evidence in the record indicates that approval of the off-site
parking would not abate public nuisance conditions and would be
detrimental to the health, safety and general welfare of the
public or other properties or improvements within the immediate
area. Specifically, traffic hazards will accrue due to the
location of the off-site parking lot (620 West 17th Street) with
respect to the Empire property (640 West 17th street) and the 17th
Street/Superior Avenue intersection.
B. Approval of the off-site parking would generate adverse impacts on
vehicular circulation, inconsistent with the intent of the
Redevelopment Plan.
C. The subject permit is to provide off-site parking for the
nightclub located at 640 West 17th Street. Since the permits for
the nightclub (Planning Action PA -93-17 and Redevelopment Action
RA -93-02) have been revoked, the subject permit is no longer
necessary.
