A RESOLUTION OF THE CITY COUNCIL. OF THE
CITY OF COSTA MESA, CALIFORNIA, AUTHORIZING
ENUMERATED EMPLOYEES TO ISSUE INFRACTION
CITATIONS.
WHEREAS, Ordinance No. 79-3 provides for issuance of citations by police officers or
designated nonsafety employees to be enumerated by resolution; and
WHEREAS, the following classes of nonsafety employees will complete a course in the
Power of Arrest; and
WHEREAS, the following classes of contract code enforcement officers shall only
possess the power to issue citations for infractions and their employment with the City of Costa
Mesa shall be subject to the terms of the agreement with the City; and
WHEREAS, California Penal Code Section 836.5 authorizes designated nonsafety
municipal employees to enforce, by citation, Municipal Code provisions;
NOW, THEREFORE, BE IT RESOLVED that the following classes of nonsafety
employees of the City of Costa Mesa are hereby designated and authorized to exercise the
powers contained in and limited to California Penal Code Section 836.5, including the power
to arrest without warrant upon reasonable cause and the power to issue citations for
misdemeanors or infractions whenever such employee has reasonable cause to believe that the
person to be arrested or cited has committed a violation of the provisions of the Costa Mesa
Municipal Code ("CMMC"):
1. Class 1: All titles of the CMMC for the following classifications:
Fire Marshal
Code Enforcement Officer
2. Class 2: Subject to certification by the City Manager or Police Chief that
proper training has been completed, the titles under CMMC as designated for the following
classifications:
Assistant Development Services DirectorBuilding - 5, 13, and 15
Assistant Development Services Director/Planning - 13
Chief Plans Examiner - 5, 13, and 15
Plan Checker - 5, 13, and 15
Chief Building Inspector - 5, 13, and 15
Building Inspector - 5, 13, and 15
Principle Planner - 13
Senior Planner - 13
Associate Planner - 13
Fire Protection Specialist - 4 and 7
Fire Engineer - 4 and 7
Project Administration Manager - 8, 11, 12, and 15
Associate Engineer - 8, 11, 12, and 15
Chief Construction Inspector - 5, 8, 11, 12, and 15
Assistant Street Superintendent - 8, 11, 12, and 15
Senior Maintenance Supervisor - 8, 11, 12, and 15
Maintenance Supervisor - 8, 11, 12, and 15
Lead Maintenance Worker - 8, 11, 12, and 15
Senior Maintenance Worker - 8, 11, 12, and 15
Animal Control Officer - 3, 8, 11, 12, and 15
Crime Scene Specialist - 10, 11, 12, and 15
Crime Prevention Specialist - 10, 11, 12, and 15
Community Service Specialist - 10, 11, 12, and 15
Revenue Supervisor - 4, 9, and 16
Tax Audit Specialist - 4, 9, and 16
Business License Inspector - 4, 9, and 16
Fire Protection Analyst - 4 and 7
Battalion Chief - 4 and 7
Fire Captain - 4 and 7
3. Class 3: Subject to the terms of their agreement with the City, the titles
under the CMMC as designated by contract for citation for infractions for the following
classifications:
Contract Code Enforcement Officer
Contract Building Inspector
Contract Housing Inspector
