A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA, REQUESTING
THE ORANGE COUNTY TRANSPORTATION AUTHORITY
TO ALLOCATE MEASURE M FUNDS FOR RIGHT-OF-
WAY ACQUISITION FOR THE HARBOR BOULEVARD
AND BAKER STREET (DALE WAY TO DATE PLACE)
IMPROVEMENT PROJECT.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, the Orange County Transportation Authority approved a Measure M Streets
and Roads Program for fiscal year 1995-96; and
WHEREAS, the program includes $620,000.00 in fiscal year 1994-95 for an intersection
improvement project at Harbor Boulevard and Baker Street (Dale Way to Date Place); and
WHEREAS, the City of Costa Mesa has adopted a General Plan Circulation Element
which does not preclude implementation of the Master Plan of Arterial Highways within its
jurisdiction; and
WHEREAS, the City of Costa Mesa has initiated negotiations for the acquisition of right-
of-way; and the City of Costa Mesa has completed the required preparatory work in accordance
with the standards required by the City and other affected jurisdictions involved with said
project;
NOW, THEREFORE, BE IT RESOLVED that the City of Costa Mesa hereby requests
that the Orange County Transportation Authority allocate $558,000.00 of Measure M funds from
the Intersection Improvement Program for right-of-way acquisition for the Harbor Boulevard and
Baker Street (Dale Way to Date Place) Project to the City. This request is in conformance with
the Measure M allocation process and does not exceed ninety (90) percent of the programmed
amount.
BE IT FURTHER RESOLVED that the City of Costa Mesa agrees to fund any additional
costs over the identified programmed Measure M dollars.
BE IT FURTHER RESOLVED that the remaining ten (10) percent in Measure M funds
will be transferred to the City of Costa Mesa when right-of-way acquisition is complete and a
final report on the project is accepted by the Orange County Transportation Authority. The City
of Costa Mesa agrees to submit the final report to the Orange County Transportation Authority
within ninety (90) days after the City's acceptance of the right-of-way documents.
