The application has been approved, based on the following project description and findings, subject to the conditions set forth below: PROJECT DESCRIPTION The applicant requests an administrative adjustment from front setback • requirement (20 ft. required; 12 ft. proposed) for a first floor expansion, including the addition of a porch, and a minor design review for a second floor addition to an existing single family residence. The first floor expansion includes a new entry closet, bathroom and bedroom at the front of the house. The second floor will include a 1 ,238 sq. ft. multi-purpose room with a full bathroom and a 50 sq. ft. deck at the rear. Administrative Adiustment (First Floor Room and Porch Addition) . The property is located near the end of a cul-de-sac, where the front property line begins to curve in on the right (north) side. A portion of the existing house has a 15 ft. front setback. The proposed room addition will be set back 16 ft. to 18 ft. from the front property line. The applicant requests an administrative adjustment to allow a porch column to encroach 8 ft. into the required 20 ft. front setback. Since the porch will be an open area (not enclosed by walls), it will not result in a substantial increase in building mass. In-addition, the proposed first floor expansion will reduce the existing concrete entry area, however, it will not affect the existing front yard landscape. • 77 FAIR DRIVE Boidng Division (714)754.5273 • Code Enforcement (714)754.5823 • Planning Division (714)7545245 FAX(714)754.4858 • 7DD(714)'751-5244 zA-01-70 February 7, 2002 Page 2 Minor Design Review (Second Floor Addition) A minor design review is required for any second-floor addition in the R-1 (Single Family Residence) zone to ensure proper design consideration and compatibility with surrounding properties. The proposal complies with the residential design guidelines by providing variation in roof forms, orientation and pitch for visual interest, as well as architectural projections and offsets to avoid blank walls. The second floor area is not more than 44 % of the floor area of the first floor, and will be set back further from the front (east) and right (north) property lines than the first floor. Second story windows will not intrude on the privacy of adjacent properties because the rear windows are approximately 32 ft. from the rear property line, the three windows proposed on the left (south) elevation are raised, and no windows are proposed on the right (north) side. The proposed deck at the rear looks over a patio roof cover of the adjacent residence to the left (south), and does not have direct view into any window. Many of the surrounding property owners have seen the proposed design and signed a letter to support the project. Two of the neighbors are concerned about location and noise impact from the air conditioning (A/C) unit. The existing unit is an old model, currently located on the left (south) side of the house. This.A/C unit will be replaced by a new one, which will generate less noise. The elevation drawings show a rooftop location for the new unit, however, the applicant is aware, and a condition has been included to prohibit any mechanical equipment on the rooftop. The applicant will be required to show how noise impact from the A/C unit will be mitigated and planning staff must approve the final location. FINDINGS 1 . The information presented substantially complies with Section 13-29(e) and 13-29(g)(1 and 14) of the Costa Mesa Municipal Code in that: a. The property is located near the end of a cul-de-sac, where the street begins to widen and the right (north) side of the.property is shorter than the left (south) side. The existing house that is currently located on this irregularly shaped lot has only a 15 ft. front yard setback. Because of these special circumstances applicable to the property, the strict application of the development standards would deprive the property of privileges enjoyed by others in the vicinity under identical zoning classifications. b. The deviation is subject to conditions to assure that the deviation authorized shall not constitute a grant of special privileges inconsistent with the limitation upon other properties in the vicinity and zone in which ZAP-01-70 D February 7, 2002 Page 3 the property is situated. c. The granting of the deviation will not allow a use, density, or intensity which is not in accordance with the general plan designation for the property. d. Theproposed development and use is compatible and harmonious with uses both on-site as well as those on surrounding properties. e. Safety and compatibility of the design of the buildings, parking areas, landscaping, luminaries, and other site features including functional aspects of the site development such as automobile and pedestrian circulation have been considered. f. The proposed project complies with applicable performance standards prescribed in the Zoning Code. g. The project is consistent with the General Plan. h. The planning application is for a project-specific case and does not establish a precedent for future development. i. The cumulative effects of all past and present planning applications have been considered for both the subject property and surrounding properties. • The proposed development is substantially compatible and harmonious j. with existing and/or anticipated development on surrounding properties. This includes site planning, landscaping, appearance, scale of structures, location of windows, and any other applicable features relative to a compatible and attractive development. The proposal includes variation in architectural elements and the window placement has no direct view into any adjacent neighbors' window. 2. The project has been reviewed for compliance with the California Environmental Quality Act (CEQA), the CEQA Guidelines, and the City environmental procedures, and has been found to be exempt from CEQA. 3. The project is exempt from Chapter XII, Article 3 Transportation System Management, of Title 13 of the Costa Mesa Municipal Code. CONDITIONS OF APPROVAL Ping. 1 . All new construction shall be architecturally compatible with regard to building materials, style, colors, etc. with the existing structure. Plans T ZA-01-70 -- February 7, 2002 Page 4 submitted for plan check shall indicate how this will be accomplished. 2. No rooftop mechanical equipment shall be permitted. The proposed A/C unit shall be relocated under the direction of the Planning Division. Plans submitted for plan check shall also indicate how noise generated from the A/C unit will be buffered. 3. Street address shall be displayed on the fascia adjacent to the main entrance or front door in a manner visible from the public street. Numerals shall be a minimum 6" in height with not less than ''/z " stroke and shall contrast sharply with the background. 4. The conditions of approval and ordinance or code provisions of zoning action ZA-01-70 shall be blueprinted on the face of the site plan. 5. The applicant shall contact the Planning Division to arrange for a Planning inspection of the site prior to the release of utilities. This inspection is to confirm that the conditions of approval and code requirements have been satisfied. Eng. 6. Maintain the public right-of-way in a "wet-down" condition to prevent excessive dust and promptly remove any spillage from the public right-of- way by sweeping or sprinkling. CODE REQUIREMENTS The following list of federal, state and local laws applicable to the project has been compiled by staff for the applicant's reference. Any reference to "City" pertains to the City of Costa Mesa. Ping. 1 . Approval of the Zoning Action is valid for one (1 ) year and will expire at the end of that period unless building permits are obtained or the applicant applies for and is granted an extension of time. 2. All contractors and subcontractors must have valid business licenses to do business in the City of Costa Mesa. Final inspections will not be granted until all such licenses have been obtained. Eng. 3. At the time of development submit for approval an off-site plan to the Engineering Division and grading plan to the Building Division that shows sewer, water, existing parkway improvements and the limits of work on the site, prepared by a civil engineer or architect. Construction access approval must be obtained prior to building or engineering permits being issued by the City of Costa Mesa. Pay offsite plan check fee to the Engineering Division. An approved offsite plan and fee shall be required prior to engineering/utility permits being issued by the City. 4. A construction access permit and deposit of $350 for-street sweeping will be required by the Engineering Division prior to the start of any on- or off-site work. Bldg. 5. Comply with the requirements of the Uniform Building Code as to design and construction. ZA-01-70 February 7, 2002 Page 5 Fire 6. Provide approved smoke detectors to be installed in accordance with the 1997 Edition of the Uniform Fire Code. Pay applicable Newport Mesa Unified School District fees to the Building Division prior to issuance of building permits. The decision will become final at 5:00 p.m. on February 14, 2002, unless appealed by an affected party or a member of the Planning Commission or City Council.
