A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA, OPPOSING
ASSEMBLY BILL 2109 RELATING TO THE
CONSOLIDATION OF SPECIAL DISTRICTS IN ORANGE
COUNTY.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, the Orange County bankruptcy has focused attention on the issue of special
districts; and
WHEREAS, Assembly Speaker Curt Pringle has sponsored Assembly Bill 2109 entitled
the "Special District Efficiency Act"; and
WHEREAS, AB 2109 consolidates water districts into two districts; one in south Orange
County and one in north Orange County; and
WHEREAS, Mesa Consolidated Water District (MCWD) would either be merged with
the City of Costa Mesa or consolidated with Irvine Ranch Water District (part of a subdivision
of the South Orange County Division) by approval of the City Council or MCWD Board, or
both; and
WHEREAS, if one of these two options does not occur by December 31, 1998, the
choice would be left to a vote of the people; and
WHEREAS, AB 2109 does not present the option of MCWD remaining an independent
special district; and
WHEREAS, with that omission, AB 2109 removes the right of Costa Mesa voters to
decide the governance of their Water District based on all options, including preservation of the
existing District or privatization; and
WHEREAS, no analysis of actual cost savings or efficiencies have been publicly
documented;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa
Mesa hereby opposes Assembly Bill 2109 unless amended to allow for the full range of options
by the voters of Costa Mesa.
