A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF COSTA MESA, CALIFORNIA, APPROVING
THE CITY OF COSTA MESA SECTION 3 ECONOMIC
OPPORTUNITIES PLAN.
WHEREAS, the City of Costa Mesa ("City") has applied for and received certain federal
funds from the United States Department of Housing and Urban Development ("HUD") under
the Housing and Community Development Act of 1974, as amended, including Community
Development Block Grant ("CDBG") funds (42 U.S.C. Sections 5310 et seq.) and HOME
Program funds (42 U.S.C. Sections 12701 et seq.); and
WHEREAS, CDBG and HOME funds are subject to the requirements of Section 3 of the
Housing and Cofnmunity Development Act of 1968, as amended, (12 U.S.C. Section 1701u) and
the implementing regulations thereunder (24 CFR Part 135)("Section 3"); and
WHEREAS, Section 3 requires that employment and other economic opportunities
generated by certain HUD financial assistance shall, to the greatest extent feasible, and
consistent with existing Federal, State, and local laws and regulations, be directed to low- and
very low-income persons, particularly those who are recipients of government assistance for
housing, and to business concerns which provide economic opportunities to low- and very low-
income persons; and
WHEREAS, the City, as a recipient of HUD financial assistance subject to Section 3,
is delegated certain responsibilities to comply with Section 3 in its own operations and ensure
compliance in the operations of its contractors and subcontractors (24 CFR Section 135.32); and
WHEREAS, pursuant to such responsibilities, the City has prepared the "City of Costa
Mesa Section 3 Economic Opportunities Plan" with accompanying Exhibits which set for the
City's implementing procedures and reporting documentation for compliance with Section 3
requirements;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF COSTA
MESA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council approves and adopts the "City of Costa Mesa Section
3 Economic Opportunities Plan" (the "Plan"). A copy of the Plan shall be placed on file with
the Office of the City Manager of the City.
SECTION 2. The City Manager of the City (or his designee) is hereby authorized and
directed to implement the Plan and to prepare or cause to be prepared such other documentation
and to undertake such actions as he deems necessary and appropriate to administer the City's
obligations, responsibilities, and duties to be performed thereunder and pursuant to Section 3.
SECTION 3. The City Manager of the City (or his designee) is further authorized to
the extent necessary in the implementation of the Plan and the City's Section 3 responsibilities,
to make revisions and modifications to the Plan, including without limitation the Exhibits
thereto; and said revisions and modifications must be approved by the City Attorney.
SECTION a. On or before June 30, 1997, and annually thereafter, the City Manager
of the City shall present to the City Council a report of the City's compliance with Section 3.
