RESOLUTION NO. 18-44 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ESTABLISHING AND ADOPTING SCHEDULES OF FEES FOR FISCAL YEAR 2018-2019 FOR SERVICES PROVIDED BY THE CITY OF COSTA MESA DEVELOPMENT SERVICES DEPARTMENT THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City Council of the City of Costa Mesa has heretofore established various schedules of rates, fees, and charges for services provided by the City including, but not limited to, rates, fees, and charges for the rental of facilities, building permits, public services, and public safety; and WHEREAS, pursuant to the provisions of the California Constitution and the laws of the State of California, the City of Costa Mesa is authorized to adopt and implement rates, fees, and charges for municipal services; provided, however, that such rates, fees, and/or charges do not exceed the estimated reasonable cost of providing such services; and WHEREAS, California Government Code Section 66016 requires notice to be given and data made available at specified times prior to the adoption of increases in existing rates, fees, and charges, or the adoption of new rates, fees, and charges for use permits and building inspections sometime hereinafter at a public meeting of this City Council; and WHEREAS, California Government Code Section 66018 requires notice to be published in accordance with California Government Code Section 6062a and data made available concerning rates, fees, and charges prior to conducting a public hearing with respect to the adoption of increases in rates, fees, and charges, or the adoption of Resolution No. 18-44 Page 1 of 4 new rates, fees, and charges for which no other procedure is provided by law; and WHEREAS, pursuant to California Government Code Section 66016, this City Council has held at least one public hearing and received oral and written presentations thereat with respect to "user fees" prior to the adoption of this Resolution; and WHEREAS, pursuant to California Government Code Section 66018, this City Council has conducted and concluded a duly noticed public hearing with respect to the rates, fees, and charges prior to the adoption of this Resolution; and WHEREAS, this City Council desires to adjust the rates, fees and charges, and to implement new rates, fees, and charges for various government services provided by the City of Costa Mesa as set forth herein; and WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred; NOW, THEREFORE, BE IT RESOLVED as follows: Section 1: This City Council hereby finds and determines that based upon the data, information, analysis, oral and written documentation presented to this City Council concerning the rates, fees, and charges described in Exhibit "A" attached hereto and by this reference incorporated herein, the rates, fees, and charges set forth in said Exhibit "A do not exceed the established reasonable cost of providing the service for which the rates, fees, or charges are levied. Section 2: The rates, fees, and charges set forth in Exhibit "A" as further described below, are hereby adopted and approved as the rates, fees, and charges for the services identified for each such rate, fee, and/or charge: Exhibit "A" -- Development Services Fee Memorandum & Appeal Fee Information Resolution No. 18-44 Page 2 of 4 Section 3: The Building Permit fees and charges set forth in Exhibit "A" shall be implemented commencing September 1, 2018, which is at least 60 days after Council adoption. All other fees shall be implemented July 1, 2018. Section 4: Immediately upon the effective date of the rates, fees, and charges set forth in Exhibit "A", any previously established rates, fees, and/or charges shall be, and the same are hereby superseded by the rates, fees, and charges established in Section 5: Thereafter, the Building Permit Fee Schedule shall be adjusted annually from July 1, 2019 by an escalation factor equal to changes in the Consumer Price Index for All Urban Consumers for the Los Angeles - Riverside - Orange County area ("CPI -U"), published by the US Department of Labor, Bureau of Labor Statistics, which shall be calculated each May based on changes in the CPI -U from the previous May. These CPI adjusted fee updates will be reflected in an annual fee Resolution. Section 6 : The City Clerk shall certify to the adoption of the Resolution. Specifically, building permit fees have not been updated in over 20 years. Staff analysis indicates that since the fees were last updated in 1997, the consumer price index has increased by 52.7 percent. Further, survey data from a number of local cities finds permit rates for those cities higher than those of Costa Mesa by a similar 53 percent. As such, staff is recommending the building permit fees be increased per the attached fee schedule (which reflects an average increase in fees of approximately 53 percent) and that the City Council establish an automatic annual increase equal to increases in the consumer price index. For Other Inspections and Fees (Section 5 of the attachment), a straight cost -recovery amount is proposed. DISCUSSION The current fees are based on the 1997 Uniform Building Codes and have not been changed since then. Building Code requirements have increased substantially in both complexity and scope since 1997. Major revisions include additional provision for disabled access, energy compliance and green building code standards. Additionally, salary and benefit costs have increased, adding to the overall cost of providing services. Additionally, US Bureau of Labor Statistics figures indicate an increase in the Consumer Price Index (CPI) of 52.7 percent since 1997. Building fees are intended to offset the costs of providing services related to plan review and inspection of building -related permits. Because the City's fees have failed to keep pace with the costs to provided services, the General Fund is subsidizing the cost of development. The following table depicts the current level of General Fund subsidy. Approach 1: Using Inflation Rate The CPI is prepared by the US Bureau of Labor Statistics and is a measure of the average change over time in the prices paid by urban consumers for a market basket of consumer goods and services. The CPI is the most widely used measure of inflation. It provides information about price changes in the Nation's economy to government, business, labor, and private citizens. Using the CPI average annual rate change, price levels in 2017 are approximately 52.7 percent higher than 1997 when fees were established. (245.15/160.525 = 1.527). Hence one approach would be to increase fees by 52.7 percent. A total of seven cities responded as indicated in Table 2. Responses showed permit fees generally higher than those for Costa Mesa. The mean permit fees for all permit types surveyed from the responding cities is approximately 53 percent higher than building permit fees for Costa Mesa. Because the CPI applies across the board, staff recommends using this index as the means to address the recommended fee increase. In contract, while the surveyed fees show a mean variance of +53 percent when compared to Costa Mesa fees, these fees vary significantly on an item by item basis. While not recommending the use of the surveyed fees to determine the revised fee schedule, staff believes this information strongly reinforces the appropriateness of the use of the CPI to update the fee schedule. In order to avoid falling behind in the future, staff recommends the City Council authorize and direct the Building Division to adjust permit fees on July 1 or each year using the US Bureau of Labor Statistics CPI for the Los Angeles -Riverside -Orange County Metropolitan area. These automatic fee updates will be reflected in the annual fee resolution. FISCAL IMPACT The impact of the proposed building fee update will result in near full cost recovery of services provided by the Building Division. The fee changes will also result in eliminating reliance on the City's general fund to pay for the services rendered by the Building Division. Future automatic CPI increases would ensure the continuity of self - funding the services provided by the Building Division. ALTERNATIVES City staff has had initial discussions with the Building Industry Association of Orange County (BIAOC). A BIAOC representative indicated that fee increases, as proposed, primarily impact projects in mid review. To address this issue, staff proposes to grandfather the existing fees for projects submitted prior to September 1, 2018. The City Council could consider extending this timing. The appeal fee in Costa Mesa is a flat fee of $690 for an appeal of a non -Planning Commission decision and $1,220 for an appeal of a Planning Commission (PC) decision. A range of appeal fees are charged by other cities in Orange County. Staff is recommending that appeal fees be maintained for appeals filed by non -applicant Costa Mesa residents while fees be increased for applicants to a flat of $3,825. If approved, fees would take effect beginning July 1, 2018. DISCUSSION From January 2016 to present, a total of 74 City decisions were appealed: 45 decisions were appealed to the City Council and 29 to the Planning Commission. Of the total, the vast majority were appealed by applicants with the remainder appealed by City residents or called up for review by City officials. A range of appeal fees are charged by other cities in Orange County. Most cities charge a flat fee like Costa Mesa. Four Orange County cities (Irvine, Anaheim, Laguna Niguel and Lake Forest) apply an hourly rate or use a deposit -based system whereby an initial deposit is collected and if staff's processing time exceeds the hours the deposit covers, fees are charged at an hourly rate for full cost recovery. In addition, some cities charge different rates depending on who is appealing (e.g. applicant versus non -applicant); which decision-making body is being appealed to (e.g. Planning Commission versus City Council); and to a lesser extent consideration is given to the type of project being appealed (e.g. residential versus non-residential) with the least expensive fees being associated with residential projects and the most expensive fees with commercial projects. Staff surveyed all Orange County cities and obtained information from all but two cities. The average appeal fee (adjusting for similar scenarios) is approximately $1,600, ranging from $50 to over $6,500 depending on the scenario. RECOMMENDATION Compared to surrounding cities, Costa Mesa's appeal fees are low. Though a deposit - based system would be best from a cost recovery standpoint, the City's time reporting system does not yet have the capacity to track staff time in a manner that would support a deposit -based system. As such, staff is recommending an increase in the existing flat fee beginning July 1, 2018. The proposed fees are structured to maintain existing fee levels for appeals filed by non -applicant Costa Mesa residents, while increasing fees for appeals filed by a project applicant. This approach discourages frivolous appeals and continues to facilitate appeals from Costa Mesa residents at current fee levels, while implementing a fee structure for applicants that is closer to cost recovery for the City. The proposed fees represent the mean of the fees applied by Huntington Beach and Santa Ana, which are the larger of the surrounding cities and have fees that are closer to cost recovery. These tees have not been updated in many years which has resulted in a heavy taxpayer subsidy of developer -initiated discretionary applications. In 2017, the City Council directed staff to expand public hearing noticing for sober living homes to include occupants, as well as owners, of properties located within 500 feet of a property seeking entitlement. City staff has initiated a code amendment which would expand this new noticing requirement to all public hearing items. Planning application fees do not cover noticing costs such as mailouts (materials, processing and postage) or newspaper publishing casts, nor are additional rounds of noticing far .Planning Commission or City Council reviews or appeals covered by said fees. These costs are currently covered by the department using general fund subsidies. New, more broad noticing requirements will more than double the mailout costs starting in FY 18 -19 - Staff proposes to amend the Planning's discretionary application fee to include a direct cost -recovery component to carver the costs associated with project noticing. DISCUSSION In advance of the planned update to Planning fees, staff proposes to add a direct cost - recovery component to the application fee to cover the costs of discretionary project noticing. This cost recovery will be rolled into Planning's discretionary application fee and will vary by project depending on the number of addresses within the 500 -foot // noticing radius. Additionally, an applicant would be required to provide additional funds in the case of multiple rounds of public noticing. Staff recommends the following noticing cost -recovery rates: Tier 1 (applications noticed by postcard) Mailout costs: $1 per address Publishing Costs: Actual cost, approximately $160 is typical Tier 2 (applications noticed by letter) Mailout costs: $1.40 per address Publishing Costs: Actual cost, approximately $400 is typical Discretionary applicants would be required to pay the proposed cost -recovery component of the application fee prior to project noticing, at a time when the exact cost can be determined. FISCAL IMPACT The impact of the proposed amendment to the Planning discretionary application fee would result in a direct cost -recovery to cover the costs associated with project noticing. With increased noticing requirements, discretionary noticing costs are expected to increase to over $50,000 in FY 18-19. The proposed cost -recovery component to the application fee would also result in eliminating reliance on the City's general fund to subsidize a portion of the cost for developer -initiated discretionary applications.
