RESOLUTION NO. - 9�
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, APPROVING
PLANNING ACTION PA -96-49.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, an application was filed by Foothill Project Management,
authorized agent for Richard Rey, with respect to real property at 1520 Ponderosa
Avenue, requesting approval of a Conditional Use Permit to allow an automobile
dealership with some washing and detailing and minor repair in the C1 zone; and
WHEREAS, a duly noticed public hearing was held by the Planning Commission
on September 9, 1996, at which time the application was denied; and
WHEREAS, the applicant filed an appeal of said Planning Commission decision
on September 13, 1996; and
WHEREAS, the City Council held a duly noticed public hearing on
October 7, 1996;
NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the
record and findings contained in Exhibit "A", and subject to conditions
contained in Exhibit "B", the City Council hereby APPROVES Planning Action
PA -96-49 with respect to the property described above.
BE IT FURTHER RESOLVED that the Costa Mesa City Council does
hereby find and determine that adoption of this Resolution is expressly predicated
upon the development of this project as specified in the staff report for Planning
Action PA -96-49. Should any material change occur in the proposed development,
or should the applicant fail to comply with the conditions of approval, then this
Resolution, and any approvals herein contained, shall be deemed null and void.

EXHIBIT "A"
PLANNING STAFF FINDINGS
APPL. PA -96-49
A. The information presented substantially complies with Costa Mesa Municipal Code
Section 13-347 in that the proposed use is substantially compatible with developments in
the same general area. Granting the Conditional Use Permit will not be detrimental to the
health, safety and general welfare of the public or other properties or improvements within
the general vicinity. And granting the Conditional Use Permit will not allow a use, density
or intensity which is not in accordance with the General Plan designation for the property.
Specifically, the use is compatible with the zone in which it is located in proximity to the
"Harbor Boulevard of Cars" and is, therefore, consistent with existing uses in the area.
Furthermore, implementation of the Conditions of Approval will allow the use to be
conducted without generating adverse impacts on adjacent residents.
B. The project has been reviewed for compliance with the California Environmental Quality
Act (CEQA), the CEQA Guidelines and the City environmental procedures and has been
found to be exempt..
C. The project is exempt from Article 22-1/2, Transportation System Management, of Title 13
of the Costa Mesa Municipal Code.

CONDITIONS OF APPROVAL

Ping 1. The barbed wire on top of the left/west side and rear/north property line fences
shall be removed within 30 days of Planning Commission action.
2. The security lighting shall be relocated or shielded so it does not spill-over into
the neighboring residential bedroom windows under the direction of the
Planning Staff. This condition shall be completed within 30 days of Planning
Commission action.
3. All landscaping originally required to be provided as a part of ZE-77-64 shall
be reinstalled on the property under the direction of the Planning Staff. This
condition shall be completed within 30 days of Planning Commission action.
4. Employee parking in front of the building shall be designated on the site under
the direction of Planning Staff. This condition shall be completed within 7
days of City Council action.
5. Hours of operation shall be limited to 8 a.m. to 6 p.m., Monday through Friday
and 9 a.m. to 6 p.m., Saturday.
6. The business shall be limited to limited repair work as described in the staff
report and washing and detailing of automobiles to be sold at the 2901 Harbor
Boulevard location only.
7. The Conditional Use Permit herein approved shall be valid until revoked. but
shall expire upon discontinuance of the activity authorized hereby for a period of
180 days or more. The Conditional Use Permit may be referred to the Planning
Commission for modification or revocation at any time if the Conditions of
Approval have not been complied with, if the use is being operated in violation
of applicable laws or ordinances, or if, in the opinion of the Development
Services Director or his designee, any of the findings upon which the approval
was based are no longer applicable.
8. Street addresses shall be displayed on the freestanding sign or, if there is no
freestanding sign, on the fascia or store front adjacent to the main entrance of the
building, in a manner visible to the public street. Numerals shall be a minimum
12" in height with not less than 3/4" stroke and shall contrast sharply with the
background. Identification of individual units shall be provided adjacent to the
unit entrances. Letters or numerals shall be 4" in height with not less than 1/4"
stroke and shall contrast sharply with the background.
9. A copy of the Conditions of Approval for the Conditional Use Permit must be
kept on premises and presented to any authorized City official upon request..
New business/property owners shall be notified of conditions of approval upon
transfer of business or ownership of land.
10. No loudspeaker or PA system may be installed which is audible outside the
building.
11. Vehicle "walk-arounds" may only be conducted on this site. Demonstration
drives should be limited to commercial streets to the extent possible.
Demonstration drives may not stop on residential streets, except as required by
traffic of trafficcontrol devices.
12. Flags, banners, signs and pennants shall be prohibited to be displayed on the
cars. The use of flags, banners, pennants and portable signs is prohibited off-
site as well.
13. No retail sales of cars shall occur at this location.
CODE REQUIREMENTS
The following list of Federal, State,.and local laws applicable to the project has been compiled
by Staff for the applicant's reference. Any reference to "City" pertains to the City of Costa
Mesa.

Permits shall be obtained for all signs according to the provisions of the Costa
Mesa Sign Ordinance.
All work shall be conducted under -roof. Outdoor work or display is prohibited.
Four (4) sets of detailed landscape and irrigation plans shall be required as part
of the project plan check review and approval process. Three (3) sets shall be
provided to the representative Water Agency and one (1) set shall be submitted
• to the Planning Division for review. Plans shall be approved by the Water
• Agency with two (2) approved sets forwarded by the applicant to the Planning
Division for final approval prior to issuance of building permits.
Two (2) sets of landscape and irrigation plans. approved by both the Water
Agency and the Planning Division. shall be attached to two of the final building
plan sets.
Landscape and irrigation plans shall meet the requirements set forth in Costa
Mesa Municipal Code Sections 13-263 through 13-266 as well as irrigation
requirements set forth by the Water Agency. Consult with the representative
Water Agency Mesa Consolidated Water District, Ray Barela - (714)631-1291
for requirements.
All landscaped areas shall be separated from paved vehicular areas by 6" high
continuous Portland cement concrete curbing.
Comply with the requirements of the Uniform Building Code as to design and
construction and CCR Title 24 pertaining to "Disabled Access Regulations".
Submit Development Plan to the Transportation Services Manager for review
and approval of driveway approaches and internal circulation prior to issuance
of permits.
Revise development plan to:
a. provide adequate turning radius of at least 15 feet inside and 26 feet
outside for each parking space aisle or corner.
b. provide standard stall and aisle dimensions for all parking spaces.
c. resolve all parking stall access problems.
*All parking spaces and aisle dimensions must conform to City of Costa Mesa
Parking Standards.
Fire 10. A Fire Department permit for repair garage is required.
SPECIAL DISTRICT REQUIREMENTS
The requirements of the following special district are hereby forwarded to the applicant:
Sani. 1. Applicant shall pay all applicable Sanitary District fixture fee charges (714)
754-5307.
2. Car detailing operation plans shall be submitted for approval to the Costa Mesa
Sanitary District (714) 631-1731 and shall include provisions preventing wash
down water from entering the street or storm drain system and also preventing
rain water from entering the sewer system.
