A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, RATIFYING THE CITY
MANAGER'S EXPENDITURE OF FUNDS TO ABATE AN
EMERGENCY AT THE COSTA MESA CORPORATION
YARD.
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AND FIND AS FOLLOWS:
WHEREAS, on December 12, 1996, it was discovered that a hazardous fuel line
leak had occurred at the Costa Mesa Corporation Yard resulting in the discharge of
motor fuel into the ground adjacent to the fuel lines; and
WHEREAS, such fuel line rupture has caused the shut down of fueling
operations to the City of Costa Mesa motor vehicles which has resulted in a
significant disruption of fueling operations at the Costa Mesa Corporation Yard, the
central location for such operation for such motor vehicles; and
WHEREAS, based on such safety hazards and adverse impacts on City of Costa
Mesa fueling operations, the City Manager determined that an emergency existed to
warrant the immediate repair of the fuel lines at the Costa Mesa Corporation Yard and
that compliance with formal bidding requirements under the California Public Contracts
Code are not reasonably possible due to such safety hazards and adverse impacts on
fueling operations.
NOW, THEREFORE, the City Council of the City of Costa Mesa does hereby
resolve as follows:
1. Finds that an emergency exists under Public Contracts Code Section
20168 to waive the formal bidding requirements for repair of the fuel
lines at the Costa Mesa Corporation Yard.
2. Ratifies the action by the City Manager to cause the immediate
expenditure of funds to repair the fuel lines at the Costa Mesa
Corporation Yard in order to safeguard life, health, and property of the
City of Costa Mesa.
