HomeMy WebLinkAbout97-15 - Establish a Reduced Traffic Impact Fee within the Newport Blvd Specific Plan AreaRESOLUTION NO. - i5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, TO ESTABLISH A REDUCED TRAFFIC IMPACT FEE FOR NEW DEVELOPMENTS WITHIN THE NEWPORT BOULEVARD SPECIFIC PLAN AREA IN THE CITY OF COSTA MESA. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, California Government Code Section 66000 et seq. enables cities to charge fees for transportation facilities; and WHEREAS, on May 17, 1993, the City Council adopted Ordinance 93-11 authorizing the adoption of a traffic impact fee; and WHEREAS, in June, 1993, the City Council adopted Resolution Nos. 93-43 and 93-53 to establish that the traffic impact fee shall be assessed upon all new development projects which have not received a building permit on or before August 6, 1993; and WHEREAS, in 1994, 1995, and 1996, the City Council adopted Resolution Nos. 94-59, 95-35, and 96-57 to reestablish the traffic impact fee and conduct an annual review of the fee and capital improvements plan; and WHEREAS, on July 15, 1996, the City Council adopted Resolution 96-69 adopting Specific Plan SP -96-01 for Newport Boulevard; and WHEREAS, the Newport Boulevard Specific Plan recommends that the traffic impact fee be reduced to the legal minimum for an initial period of five years as an incentive to allow the private market the capability of developing projects which can further the goals and objectives of the Specific Plan in the plan area; and WHEREAS, a partial exemption from the traffic impact fee for projects in the Specific Plan SP -96-01 area which results in community development consistent with the goals and objectives of the Specific Plan will benefit the public health, safety, and welfare; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa, California, does hereby adopt a reduced traffic impact fee for developments within the Newport Boulevard Specific Plan area as follows: 1. The reduced traffic impact fee shall be a fee of $108.00, or as low as allowed by Growth Management Area No. 8, per each new average daily vehicle trip end generated by all new residential developments within the plan area and a fee per each new average daily vehicle trip end generated by all new nonresidential developments with the plan area as set forth in Exhibit 'A" and incorporated herein by this reference. 2. The reduced traffic impact fee shall be effective for a period of five years. PASSED AND ADOPTED this 20th day of January, 1997.
