A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, REQUESTING THE
LOCAL AGENCY FORMATION COMMISSION TO
INITIATE PROCEEDINGS FOR THE ANNEXATION OF
THE NORTH SIDE OF OLYMPIC AVENUE AND
THE UNINCORPORATED RIGHT-OF-WAY OF THE 405
FREEWAY ADJACENT TO THE FREEWAY
(ANNEXATION NO. 97-02/SUBAREA 2).
THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY
RESOLVE AS FOLLOWS:
WHEREAS, the City Council's 1996-1997 Community Objectives Report estab-
lishes the goal of annexing unincorporated County areas into the City proactively; and
WHEREAS, the City of Costa Mesa desires to annex the north side of Olympic
Avenue and the unincorporated right-of-way of the 405 Freeway adjacent to the
freeway; and
WHEREAS, the City of Costa Mesa desires to initiate proceedings pursuant to
the Cortese -Knox Local Government Reorganization Act of 1985, commencing with
Section 56000 of the California Government Code, for the annexation of the area as
outlined in Exhibit A, and incorporated herein; and
WHEREAS, notice of intent to adopt this resolution of application has been
given to each property owner and each subject agent; and
WHEREAS, this proposal is consistent with the Sphere of Influence of the City
of Costa Mesa; and
WHEREAS, the annexation is desired for the following reasons:
1. The proposed annexation is a logical extension of the present City
boundaries and will eliminate a portion of a County island; and
2. The proposed annexation of said territory will better serve the needs of
said properties and owners; and
WHEREAS, this resolution has been prepared in accordance with, and is
requested pursuant to Section 56700 of the Public Resources Code; and
WHEREAS, a Plan for Providing Services has been prepared pursuant to Section
56653 of the Public Resources Code and is attached as Exhibit B and incorporated
herein; and
WHEREAS, the City of Costa Mesa is requesting initiation of these proceedings
and therefore the application to the Local Agency Formation Commission does not
include a petition signed by registered voters or owners of land; and
WHEREAS, the City Council finds that the proposed annexation is exempt from
the requirements of the California Environmental Quality Act since the proposal results
in no direct or primary site-specific impacts on the environment and any subsequent
development is subject to further environmental review; and
WHEREAS, the public hearing on this resolution was noticed and published in
compliance with California Government Code Section 56801;
NOW, THEREFORE, BE IT RESOLVED that this Resolution of Application
is hereby adopted and approved by the City Council of the City of Costa Mesa, and
the Local Agency Formation Commission of Orange County is hereby requested to
take proceedings for Subarea 2 as described in Exhibit A, according to the terms and
conditions stated above and in the manner provided by the Cortese -Knox Local
Government Reorganization Act of 1985.

PLAN FOR PROVIDING SERVICES
TO SUBAREA 2
(1) Municipal services provided by the City of Costa Mesa within its jurisdiction
will be provided to the affected territory subject to the attached resolution of
application for annexation which include, but are not limited to, police, fire,
development services, community services, public services and related
administration services.
(2) The level and range of services shall be equal to those currently provided by
the City of Costa Mesa within its jurisdiction.
(3) The subject services can be feasibly extended to the affected territory at the
date of annexation.
(4) No improvements or upgrades to infrastructure or other conditions are
required by the City of Costa Mesa within the affected territory if the annexation
is completed.
(5) The municipal services will be financed through sales taxes and real property
taxes assessed on the affected territory and through the use of the City of Costa
Mesa general funds.
