A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF COSTA MESA, CALIFORNIA, SUPPORTING SENATE
BILL 421.
WHEREAS, during the Orange County fiscal crisis of 1994-95 and 1995-96, the
Newport -Mesa Unified School District was a basic aid district which would have
received property taxes in excess of their revenue limits, except that certain of these
funds were held in county accounts and not available to the districts; and
WHEREAS, these funds have now been released but the district is no longer
eligible for basic aid; and
WHEREAS, as it currently stands, any property taxes received this year by the
district would offset state aid; and
WHEREAS, Senate Bill 421, an urgency measure, would allow the Newport -
Mesa Unified School District to disregard the recently released funds in the calculation
of district revenue limits for the current fiscal year (1996-97), and instead treat these
funds as having been received during the 1994-95 and 1995-96 fiscal years; and
WHEREAS, without this bill, the Newport -Mesa Unified School District would
lose $1.65 million of 1996-97 state aid due to the release of a like amount of past
year property taxes; and
WHEREAS, it would be unfair for the state to offset state aid with these funds
because the district would have been able to keep the funding had it been properly
allocated during 1994-95 and 1995-96; and
WHEREAS, to offset the funds this year would penalize the district, who,
through no fault of its own, was already harmed by the Orange County fiscal crisis;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa
Mesa supports Senate Bill 421.
