A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING THE APPLICA- TION FOR FIFTH CYCLE BLOCK GRANT FUNDS FROM THE USED OIL RECYCLING FUND UNDER THE USED OIL RECYCLING ENHANCEMENT ACT. WHEREAS, the people of the State of California have enacted the California Oil Recycling Enhancement Act that provides funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling or appropriate disposal of used oil; and WHEREAS, the California Integrated Waste Management Board (Board) has been delegated the responsibility for the administration of the program within the state, setting up necessary procedures governing application by cities and counties under the program; and WHEREAS, said procedures established by the Board require the applicant to certify by resolution the approval of application before submission of said application to the state; and WHEREAS, the applicant will enter into an agreement with the State of California for development of the project; and WHEREAS, the applicant will enter into an agreement with the Costa Mesa Sanitary District for implementation and development of the project; and WHEREAS, the applicant agrees to work with the jurisdictions of Orange County (unincorporated areas) and Newport Beach (under the auspices of the Costa Mesa Sanitary District) on a regional effort; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa, California, does hereby resolve, declare, determine, and order as follows: SECTION 1. That the City Council of the City of Costa Mesa approves the filing of an application for the California Used Oil Recycling Block Grant Program under the California Oil Recycling Enhancement Act for state grant assistance for the project specified above; and SECTION 2. That the City Council of the City of Costa Mesa certifies that said applicant has or will have sufficient funds to operate and maintain the project; and SECTION 3. That the City Council of the City of Costa Mesa appoints the Public Services Director, or his designee, as their agent to conduct all negotiations, execute and submit all documents including, but not limited to applications, agreements, amendments, payment requests, and so on, which may be necessary for the completion of the aforementioned project. SECTION 4. The City Clerk shall certify to the passage and adoption of this resolution; shall cause the same to be entered among the original resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council for the meeting at which same is passed and adopted.
