A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 20, ON SUNFLOWER AVENUE FROM 875 FEET WEST OF HARBOR BOULEVARD TO FAIRVIEW ROAD. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, a public hearing was called for July 7, 1997, at the hour of 6:30 p.m., in the Council Chambers of City Hall, 77 Fair Drive, Costa Mesa, California, to ascertain whether the public necessity, health, or welfare requires the underground installation of wires and facilities for supplying electrical, communication, or similar or associated service, within that certain area of Costa Mesa described in Exhibit "A", the legal description attached hereto and made a part hereof; and WHEREAS, notice of such hearing was given to all affected property owners as such are shown on the last equalized assessment roll, and to all utilities concerned, in the manner and time required by law; and WHEREAS, such hearing was duly and regularly held and all persons interested were given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Costa Mesa that pursuant to Title 13, Chapter VIII, Sections 13-684 through 13-700, Costa Mesa Municipal Code, the above described area is hereby declared an underground utility district and is designated as Underground Utility District No. 20 of the City of Costa Mesa. Attached hereto marked Exhibit "B" is a map delineating the boundaries of said District and is hereby incorporated as part of this Resolution. BE IT FURTHER RESOLVED that the City Council does hereby fix March 2, 1998, as the date on which affected property owners must be ready to receive underground service, and does hereby order removal of all poles, overhead wires, and associated overhead structures, and underground installation of wires and facilities for supplying electrical, communication, or similar or associated service within Underground Utility District No. 20 on April 1, 1998. BE IT FURTHER RESOLVED that the following exception in said Underground Utility District No. 20 be, and they are hereby authorized: (1) Poles or electroliers used exclusively for street lighting (or traffic signals). (2) Equipment appurtenant to underground facilities, such as surface - mounted transformers, pedestal -mounted terminal boxes and meter cabinets, and concealed ducts. (3) Temporary poles, overhead wires, and associated overhead structures used, or to be used in conjunction with construction projects. BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 20 of the adoption of this Resolution within ten (10) days after the date of adoption. Said City Clerk shall further notify said property owners of the necessity that, if they or any person occupying such property desires to continue to receive electric, communication, or other similar or associated service, they or such occupant shall, by the date fixed in this Resolution, provide all necessary facility changes on their premises so as to receive such from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations, and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this Resolution, together with a copy of Sections 13-684 through 13-700 of the Costa Mesa Municipal Code, to all affected property owners as such are shown on the last equalized assessment roll and to the affected utilities. BE IT FINALLY RESOLVED that the City Council hereby finds and determines as follows: (1) The undergrounding will avoid or eliminate an unusually heavy concentration of overhead distribution facilities. (2) The streets and rights-of-way in the District are extensively used by the general public and carry a heavy volume of pedestrian and vehicular traffic.
