HomeMy WebLinkAbout97-69 - Supporting Bay Knolls Homeowners Association Local Agecy Formation Commission (LAFCO)RESOLUTION NO. 47 69 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, SUPPORTING THE BAY KNOLLS HOMEOWNERS ASSOCIATION LOCAL AGENCY FORMATION COMMISSION (LAFCO) APPLICA- TION TO AMEND THE CITY OF COSTA MESA'S SPHERE OF INFLUENCE AND ANNEXATION TO THE CITY OF NEWPORT BEACH. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City of Costa Mesa desires to initiate proceedings pursuant to the Cortese -Knox Local Government Reorganization Act of 1985 for annexation of properties adjacent to its eastern boundary that includes an area known as the Bay Knolls Homeowners Association neighborhood (as outlined on Exhibit A) and incorporated herein; and WHEREAS, the Cortese -Knox Local Government Reorganization Act requires the termination of annexation proceedings if more than 50 percent of the property owners (or property taxpayers owning 50 percent or more of the assessed valuation of the area) are opposed to a proposed annexation; and WHEREAS, the Cortese -Knox Local Government Reorganization Act also requires a local municipality to conduct a public election if 25 to 50 percent of the property owners are opposed to an annexation; and WHEREAS, at least 50 percent of the property owners of land located within the Bay Knolls Homeowners Association neighborhood have submitted a petition opposing the City's attempt to annex; and WHEREAS, after reviewing information relating to the opposition of the annexation and analyzing the property characteristics and neighborhood configuration, the Costa Mesa City Council believes that the Bay Knolls Homeowners Association neighborhood is a logical extension to the City of Newport Beach and should therefore be included within the Sphere of Influence of the City of Newport Beach and removed from the Sphere of Influence of the City of Costa Mesa as well as its incorporated City boundaries; and WHEREAS, on August 4, 1997, the Costa Mesa City Council considered this request at a regularly scheduled meeting; and WHEREAS, notice of said public meeting was distributed to each property owner within the affected area; NOW, THEREFORE, BE IT RESOLVED that the Costa Mesa City Council supports the property owners, represented by the Bay Knolls Homeowners Association, in their petition to amend the Spheres of Influence for the cities of Costa Mesa and Newport Beach so that the area as outlined on Exhibit A is removed from the Costa Mesa Sphere of Influence and included within the Newport Beach Sphere of Influence and supports the Bay Knolls Homeowners Association and property owners' application to be annexed to the City of Newport Beach.
