HomeMy WebLinkAbout97-99 - Approving Planning Application PA-97-44RESOLUTION NO. 97-99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, APPROVING PLANNING APPLICATION PA -97-44. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, an application was filed by Gregory Beebout, authorized agent for Dorothy G. Weisler, with respect to real property located at 975-981 West 18th Street, requesting a variance from rear yard setback requirements to allow Pacific Coast Weatherproofing to legalize 10 -foot high storage sheds totaling 1,693 square feet in area, located along the rear and side property lines, in an MG zone; and WHEREAS, a duly noticed public hearing was held by the Planning Commission on October 27, 1997; and WHEREAS, the Planning Commission denied the application; and WHEREAS, the applicant appealed the Planning Commission decision to the City Council; and 1997; WHEREAS, the City Council held a duly noticed public hearing on December 1, NOW, THEREFORE, BE IT RESOLVED that based on the evidence in the record and findings contained in Exhibit "A"; and subject to conditions of approval contained in Exhibit "B", the City Council hereby APPROVES Planning Application PA -97-44 with respect to the property described above. BE IT FURTHER RESOLVED that the City Council does hereby find and determine that adoption of this Resolution is expressly predicated upon the activity described in the staff report for Planning Application PA -97-44, and upon applicant's compliance with each and all conditions contained in Exhibit "B". Should any material change occur in the operation, or should the applicant fail to comply with the conditions of approval, then this Resolution and any recommendation for approval herein contained, shall be deemed null and void. The location of the sheds will not be detrimental to the public health, safety, and welfare. EX HIBTr'B„ CONDMONS OF APPROVAL Ping. 1. All storage shall be contained within the sheds or buildings; no outdoor storage will be permitted. 2. Permits shall be obtained for the sheds and other proposed improvements on the property. 3. The variance shall be applicable only to the 10 -foot high storage sheds described in this report. 4. A copy of the conditions of approval for the conditional use permit must be kept on premises and presented to any authorized City official upon request. New business/ property owners shall be notified of conditions of approval upon transfer of business or ownership of land. 5. The sheds shall be kept in good condition at all time, including upkeep of exterior finish and roof materials. 6. To further mitigate potential noise impacts, reorient portions of shed currently located adjacent to the side property line to the rear property line, consistent with existing sheds. 7. 18 parking spaces are required. Relocate parking spaces adjacent to 16 - foot wide driveway to provide for a minimum 20-ffot wide drive aisle. 8. The conditions of approval and ordinance or code provisions of planning application PA- 97-44 shall be blueprinted on the face of the site plan. CODE REQUIREMENTS Ping. 1. All contractors and subcontractors must have valid business licenses to do business in the city of Costa Mesa. Final inspections and final occupancy will not be granted until all such licenses have been obtained. 2. Approval of the planning application is valid for one (1) year and will expire at the end of that period unless building permits are obtained or the applicant applies for and is granted an extension of time. 3. All work and storage shall be conducted under -roof. Outdoor work, storage or display is prohibited. 4. Truck deliveries shall not occur between 8:00 p.m. and 7:00 a.m. Bldg. 5. Comply with the requirements of the Uniform Building Code as to design and construction and CCR Title 24 pertaining to "Disabled Access Regulations". 6. Sheds shall drain inside the property and not cross the property line. 7. Handicap access to the sheds must be provided. Submitted plans shall indicate how that will be accomplished. 8. Provide a list of materials stored in the shed to the Fire Prevention Division and the Building Division to determine if there are any hazardous materials stored and verify the occupancy classifications. Trans. 9. Fulfill mitigation of off-site traffic impacts at the time of issuance of building permit by submitting to the Planning Division the required traffic impact fee pursuant to the prevailing schedule of charges adopted by the City Council. The traffic impact fee is calculated based upon the average daily trip generation rate of 6.97 trip ends per thousand square feet for the proposed industrial use and includes a credit for any existing use. At the current rate of $150.00 per trip end, the traffic impact fee is estimated as $1,650.00.
