HomeMy WebLinkAbout97-101 - Declaring Certain Parcels to be Surplus Property and its Intention to Dispose of said Real PropertyRESOLUTION NO. 917- /d/ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DECLARING CERTAIN PARCELS TO BE SURPLUS PROPERTY; AND DECLARING ITS INTENTION TO DISPOSE OF SAID CITY SURPLUS REAL PROPERTY. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, legal authority exists for a municipal corporation to sell or dispose of surplus land and improvements for the common benefit per Government Code Sections 54221, 54222, and 54227; and WHEREAS, the subject land, as more particularly described in Exhibits "A" and "B" attached hereto and by this specific reference made a part hereof, is found to be surplus real property and this method of sale and disposition is for the common benefit; and buyer; WHEREAS, the City desires to dispose of said land by negotiation to a qualified NOW, THEREFORE, BE IT RESOLVED that pursuant to the aforesaid authority, the City does hereby offer for sale the real property described in Exhibits "A" and "B", attached hereto. This reservation is for a right-of-way easement which shall be described and reserved in a grant deed for any transfer of the above referenced properties; In the alternative, the Public Services Department is authorized to take the necessary steps to process a lot line adjustment to the extent the City determines that ownership of the subject right-of-way is to be held in fee title by the City. 4 HAMILTON STREET - 422-091-04 Reservation: The subject resolution and City Council declaration, declaring the above property #4 to be surplus property, shall not apply to the strip of land running the width of the parcel at 5 feet from the property line adjacent to Hamilton Avenue. This reservation is for a right- of-way easement which shall be described and reserved in a grant deed for any transfer of the above referenced property; In the alternative, the Public Services Department is authorized to take the necessary steps to process a lot line adjustment to the extent the City determines that ownership of the subject right-of-way is to be held in fee title by the City. 5 135 E. 17TH STREET - 425-423-04 6 E. 17TH STREET - 425-423-18 Reservation: The subject resolution and City Council declaration, declaring the above referenced properties #5 and #6 to be surplus property, shall not apply to the 1 foot strip of land running along the southerly end of both parcels. This reservation is for a right-of-way easement which shall be described and reserved in a grant deed for any transfer of the above referenced property; In the alternative, the Public Services Department is authorized to take the necessary steps to process a lot line adjustment to the extent the City determines that ownership of the subject right-of-way is to be held in fee title by the City.
