HomeMy WebLinkAbout98-02 - Disability Retirements Under the Public Employees' Retirement LawRESOLUTION N0. 99 — oZ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COSTA MESA, CALIFORNIA, DELEGATING ITS AUTHORITY AND ASSIGNING THE RESPONSIBILITY TO MAKE CERTAIN DETERMINATIONS AND APPLICATIONS RELATING TO DISABILITY RETIREMENTS UNDER THE PUBLIC EMPLOYEES' RETIREMENT LAW, AND TO PROMULGATE RULES AND PROCEDURES TO IMPLEMENT SUCH RESPONSIBILITY. THE CITY COUNCIL OF THE CITY OF COSTA MESA DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, the City of Costa Mesa is a contracting agency of the Public Employees' Retirement System, and - WHEREAS, the Public Employees' Retirement Law requires that a contracting agency determine whether an employee of such agency is classified as a local safety member, is disabled for purposes of the Public Employees Retirement Law and whether such disability is "industrial" within the meaning of such law; and WHEREAS, the City Council is authorized under Section 21173 of the California Government Code to delegate its authority and duty to make such determinations to its City Manager and/or his designee, and finds that such delegation is in the best interests of the City; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Costa Mesa, delegates to the City Manager and/or the City Manager's designee(s) full authority on behalf of the City to make safety employee determinations under Government Code Section 21150 et seq., regarding disability, whether such disability is industrial, and related determinations, and to certify such determinations and all other necessary information to the Public Employees' Retirement System; and BE IT FURTHER RESOLVED that the City Manager and his duly designated representative is authorized and directed to promulgate such rules and procedures as appropriate to carry out this resolution; and BE IT FURTHER RESOLVED that any proceedings relating to these matters shall be deemed as before the City Council for purposes of the issuance of subpoenas;and BE IT FURTHER RESOLVED that the City Manager and/or his designee make applications on behalf of the City for disability retirement of employees in classifications in which they are either local safety or miscellaneous members and to initiate requests for reinstatement of such employees who are retired for disability; and PASSED AND ADOPTED this 5th day of January, 1998.
