HomeMy WebLinkAbout45 - Buying, Selling, and Licensing of BicyclesORDINANCE N0. AN ORDINANCE OF TEM CITY OF COSTA MESA LICENSING BICYCLES AND REG(JLATING THE BUYING AND SELLING THEREOF. The City Council of the City of Costa Mesa does hereby ordain as follows: ARTICLE I LICENSING AND REGISTRATION SECTION 1. LICENSE REQUIRED. No person shall operate a bicycle, propelled wholly or in part by muscular power, upon any street of the City without first obtaining a license therefor. SECTION 2, DURATION OF LICENSE. The Fiscal Officer,or such other person as may be designated by the City Council, is hereby author— ized and directed to issue, upon written application therefor, bicycle licenses which shall be effective for the life of the bicycle for which issued, and will entitle said bicycle to be operated upon all the streets, exclusive of the sidewalks thereof, in the City. SECTION 3• CONTENTS OF APPLICATION FOR LICENSE. Said applica— tion shall state the name and address of the owner or person in charge or control of such bicycle, the factory number thereof, the name of the person from whom the same was purchased, and such other description and information relative thereto as may, in the judgment of the Fiscal Officer, be necessary and proper for the identification thereof. SECTION 4. LICENSE PLATES AND REGISTRATION CARDS. The City shall provide metallic license plates and seals, together with registration cards, said metallic license plates and registration cards having numbers stamped thereon in numerical order, beginning with Number 19 and the letters CMBL stamped thereon; such metallic license plates shall be suitable for attachment upon the frames of bicycles, and the Fiscal Officer or ovrch other person who may be designated by the City Council shall attach one such metallic license plate to the frame of each M1— bicycle, and shall issue a corresponding registration card to the owner thereof upon the payment of the license fee herein provided for. Such metallic license plate shall remained attached during the existence of such license. SECTION 4.1 RECORDS TO BE KEPT BY FISCAL OFFICER. The City Fiscal Officer or such other person who may be designated by the City Council shall also keep a record of the date of issue of each license, to whom issued, the number thereof and the description of the bicycle to which it is attached. SECTION 5. LICENSE NOT TRANSFERRABLE. Licenses issued hereunder shall not be transferrable from one bicycle to another. ARTICLE t. LICENSE FEE SECTION 6. AMOUNT OF LICENSE FEE. The lficense fee to be paid for each bicycle shall be fifty cents (50¢) payable in advance. SECTION 41. USE OF FEES. All license fees collected hereunder shall be paid into the General Fund of this City. ARTICLE 3 BICYCLE SALES: LOSS: THEFT SECTION 8, REPORT OF SALE. Every person who sells, or transfers owner— ship of any bicycle, shall report such sale or transfer to the Chief of Police and return to the City Fiscal Officer or such other person who may be designated by the City Council the registration card issued to such person, together with the name and address of the person to whom said bicycle was sold or transferred, and such report shall be made and. said registration card returned within five (5) days of the date of said sale or transfer. The purchaser or transferee of such bicycle shall apply for a transfer or registration thereof within five (5) days of said sale or transfer, and a new registration card shall be issued to him. SECTION 9. LOST OR STOLEN IDENTIFICATION TAGS. In the event the said metal identification tag shall be lost or stolen from such bicycle, the owner or person in charge of such bicycle shall immediately notify the City Fiscal Officer of the loss of the sere, and when such owner or _z— pexaon in charge of such bicycle makes proper affidavit of the loss of said metal tag, stating the facts of said loss as nearly as possible , the City Fiscal Officer shall. issue to said owner or person in charge or control of said bicy&le , upon the payment to said City Fiscal Officer a fee of fifty cnets (500) , a new identification tag. SECTION 10, REPORT OF THEFT OR LOSS TO POLICE DEPARmMENT, Each and every owner or person in charge or control of any bicycle shall immediately notify the Police Department of the loss by theft or otherwise of any such registered bicycle. SECTION ll. BICYCLE DEALERS. All. persons dealing in bicycles in the City, either as a business or as an occasional buyer or seller of the same, shall keep at his place of business, a record of all bicycles bought and sold, which record shall at all times be open to inspection by the Police Department, SECTIOUT 12, REMOVING AND ALTERING IDENTIFICATION. No person shall wilfully or maliciously remove, destroy or alter the number on the frame of any bi— cycle licensed hereunder, and no person shall remove, destroy or alter any license tag or registration card issued on any bicycle under the provisions hereof; provided, however, that the Chief of Police shall retain the right to stamp numbers on the frames of bicycles on which no serial number can be found, or on which said numbers are illegible or insufficient for identifi— cation purposes. SECTION 13. This Ordinance shall take effect and be in force thirty (30) days from and after its passage, and prior to the expiration of fifteen (15) days from its passage shall be deka posted in three public place within the City, together with the names of the members of the Colincil voting for and against the same.
