HomeMy WebLinkAbout71 - P-1 DistrictORDINANCE NO. 71 AN ORDINANCE OF THE CITY OF COSTA MESA, CALIFORNIA, AMENDING SECTION 3.1 OF ARTICLE III, SECTION 3.2 OF ARTICLE III, SECTION 12-5 OF ARTICLE XII AND ADDING ARTICLE VI -A TO ORDINANCE NO, 32, ENTITLED "AN ORDINANCE OF THE CITY OF COSTA MESA, ESTABLISH- ING LAND CLASSIFICATIONS IN DISTRICTS WITHIN THE INCORPORATED TERRITORY OF THE CITY OF COSTA NESA, AND REGULATING THE USES OF PROPERTY THEREIN, ADOPTING A NAP OF SAID STREETS, DEFINING THE TERNS USED IN THIS ORDINANCE, PROVIDING FOR THE ADJUSTMENT, ENFORCZNENT AND AMENDNENT HEREOF, PRESCRIBING PENALTIES FOR VIOLJITION HEREOF, AND REPEALING ORDINANCES AND PARTS OF ORDINANCES INCONSISTENT AND IN CONFLICT HEREWITH" The City Council of the City of Costa Mesa, California, does ordain as follows: SECTION 1, Section 3.1 of Article III of Ordinance No. 32, entitled "AN ORDINANCE OF THE CITY OF COSTA MESA, ESTABLISHING LAND CLASSIFICATIONS IN DISTRICTS WITHIN THE INCORPORATED TERRITORY OF THE CITY OF COSTA MESA AND REGULATING THE USES OF PROPERTY THEREIN, ADOPTING A NAP OF SAID STREETS, DEFINING THE TERNS USED IN THIS ORDINANCE, PROVIDING FOR THE ADJUSTMENT, ENFORCEMENT AND AMENDMENT HEREOF, PRESCRIBING PENALTIES FOR VIOLATION HEREOF, AND REPEALING ORDINANCES AND PARTS OF ORDINANCES INCONSISTENT AND IN CONFLICT HEREWITH" is hereby amended to read as follows: Section 3.1. ESTABLISHING DISTRICTS. In order to classify, regulate, restrict and segregate the uses of land and buildings, to regulate and restrict the height and bulk of buildings, and to regulate the area of yards and other open spaces about buildings, and to regulate the density of population, seven classes of zones are established to be known as follows: R-1. Single family residence district. R-2. Group dwelling district. R-!.}.. Suburban residential district. P-1. Professional and automobile parking district. C-1. Local business district. C-2. General business district. M-1. Light industrial district. SECTION 2. Section 3.2 of Article III of Ordinance No. 32 -1- is hereby amended by adding thereto a new paragraph reading as follows: The "District Map" may, for convenience, be divided into parts, and each such part may, for purposes of more readily identifying areas within such District Map, be sub- divided into units, and such parts and units may be separately employed for purposes of amending the District Map for any official references to the District Map. Changes in the boundaries of the zones shall be made by ordinance adopting an amended District Map or part of said map, or unit of a part of said district map, which said amended maps, or parts T or units of pars, when so adopted, shall be published in the manner prescribed by law and become a part of this Ordinance. SECTION 3. Section 12.5 of Article XII of Ordinance No. 32 is hereby amended to read as follows: Section 12.5. FEE (a) The Planning Commission shall make a uniform charge of Fifty ($50.00) Dollars, payable to the City Treasurer, to partially cover the cost of making maps, sending out notices, and other incidental administrative expenses involved in any petition for a change in these regulations, said charge being due and payable at the time of filing any petition or request of change. SECTION 4. A new Article, to be known as Article VI -A setting forth the uses permitted in the P-1 District is hereby added, reading as follows: ARTICLE VI -A P-1 PROFESSIONAL AND AUTOMOBILE PARKING DISTRICT SECTION 6-A. USES PERMITTED. (1) All uses permitted in the R-1, R-2, and R-4 Districts. -2- (2) Professional offices and office buildings. (3) Open air, temporary parking of transient auto« mobiles provided that the areas no classified and used shall be paved or otherwise surfaced no as to eliminate dust. Ureas classified as P-1 shall not be used for used car sales areas. SECTION 6-B. BUILDING SIGHT LIMIT, Not to exceed thirty-five (35) feet, except the building height limit for dwelling purposes shall be two stories and not to exceed thirty-five (35) feet. SECTION 6-0. BUILDING SITE AREA RB4UIi D. The minimum building site for dwelling purposes shall be six thousand (6,000) feet, with a minimm street frontage of fifty (50) feet. SECTION 6-D. YARDS ramurtED. (1) Front oda. No building shall be erected closer than fifty (50) feet to the center line of the street or highway upon which the building site fronts. (2) Side yards. None except those buildings used solely for dwelling purposes shall not be closer than five (5) feet to the side lines of the lot. (3) Rear ;yards. The depth of the rear yard shall not be less than twenty-five (25) feet. SECTION 5. This Ardiiianee shall take effect and be in full forte thirty (30) days from and after its passage; and prior to the expiration of fifteen (15) days from the passage thereof, this Ordinance, together with the names of the members of the City Council voting ter and against the same, shall be published once in the Costa Mesa Globe Herald, a newspaper printed in the City of Costa Mesa.
