HomeMy WebLinkAbout70 - Garbage and Waste DisposalORDINANCE NO. 70 AN ORDINANCE OF THE CITY OF COSTA MESA, CALIFORNIA, REGULATING THE DISPOSAL OF GARBAGE AND WASTE MATERIAL AND PRESCRIBING THE PENALTIES OF THE VIOLATION THEREOF. The City Council of the City of Costa Mesa does ordain as follows: SECTION 1. DEFINITIONS. (a) Garbage. The word "garbage" as defined in this Ordinance shall mean waste animal and vegetable matter of every kind and character, including such waste food, animal and vegetable matter as accumulates in hotels, restaurants, eating places and private homes, in the kitchens and on the tables in such places, and also including such waste animal and vegetable matter as accumulates in meat markets and grocery stores, in fruit and vegetable markets. The particular designation herein shall not be deemed to exclude the general. (b) Rubbish. The word "rubbish" means and includes tree and shrubbery trimmings, lawn renovatings, grass, weeds, leaves, chips, paper, pasteboard, magazines, books, rags, rubber, carpets, clothing, boots, shoes, hats, straw, packing boxes and cartons, crates, packing material, and all other kinds of combustible rubbish, trash, or waste material which ordinarily accumulates in the operation of a household or business. Rubbish shall not be deemed to include manure or waste from any pHultry yard or stable. (c) Waste Material. "Waste material" shall include and mean broken crockery, broken glass, ashes, cinders, shells, bottles, tin cans, metals, and other similar non-combustible materials resulting from the operation of a household or business. SECTION 2, PERMIT REQUIRED. No person shall move or convey any garbage upon, along or across any public street, alley -1- 4 highway, or other public place in the City without first applying for and receiving a permit therefor from the City Council. SECTION 3, PERMIT, APPLICATION. Any person desiring to obtain a permit to remove or convey any garbage upon or along any public street, alley, highway or any other public place within the City shall sign and file an application with the Council,, which application shall set forth the name and address of the applicant and such further information as may be required by the Council. SECTION 4. GARBAGE CONVEYANCE REQUIREMENTS. No person shall remove or convey any garbage upon or along any public street, alley, highway or other public place within the City except in watertight receptacles, tanks or wagon boxes constructed of steel, galvanized iron or other metallic substance and mounted on wheels. Every such vessel, receptacle, tank or wagon box, while the same contains garbage, shall be securely and tightly covered and closed in such a manner as to prevent the contents thereof, or any odor therefrom, escaping. Every such vessel, receptacle, tank or wagon box shall be thoroughly cleansed daily and disinfected at least once during each week. Every vehicle carrying any such vessel, receptacle, tank or wagon box shall be so loaded and driven that none of the contents shall fall or escape therefrom. SECTION 5. REVOCATION OF PERMIT. In the event that any person holding a permit to remove or convey garbage upon or along any public street, alley, highway or other public place within the City shall violate any of the conditions of such permit or any provisions of this Ordinance or any other provision of any Ordinance of this City that may now be in force or that may hereinafter be enacted, relating to cr regulating the collection, removal or disposal of garbage, or shall remove or convey such garbage in an unlawful, improper or insanitary manner, it shall be the duty of the Council, in addition to any other penalty -2- provided by this Ordinance, to revoke such permit issued to such person. If the permit shall be revoked, no permit shall thereafter be granted to such person to remove or convey garbage. No permit granted pursuant to this Ordinance shall be assigned or transferred without the consent of the Council, and no permit shall be issued for a longer period of time than three years. SECTION 6. RECEPTACLES FOR GARBAGE. No person shall dump any garbage, table refuse or other similar substance in any box or other receptacle, nor deposit the same in anything except a tight, portable tank or receptacle fcr holding garbage. Each such vessel, tank or receptacle shall be constructed of metal and shall be watertight and shall be so constructed as to contain not less than three gallons and no more than sixteen (16) gallons and of such shape and weight as may be easily handled and shall be provided with handles on the outside thereof and with a tight fitting metal cover; and it shall be the duty of each owner or the manager of any boarding house, restaurant, hotel or eating house, every person occupying a dwelling house, and every other person carrying on any sort of business in connection with which garbage as defined in this Ordinance is commonly accumulated to keep a vessel or receptacle of the type as herein described for holding garbage. SECTION 7. GARBAGE ON STREETS PROHIBITED. No person in the City shall deposit any garbage, non-combustible house refuse, rubbage or waste matter upon any street or other public place, except for the purpose of collection hereunder. No person shall store, deposit or keep garbage in a place accessible to rats. SECTION 8. BURYING GARBAGE PROHIBITED. No person shall bury garbage at any place within the City within one hundred (100) feet of an occupied dwelling. No person shall dump or spread garbage on the surface of the ground for drying, composting or -3- mulching. No person shall burn garbage within the City except in incinerators of the type approved by the City Council for that purpose. SECTION 9. DUMPING TRASH ON STRERTS PROHIBITED. No person shall dispose of or dump upon any public property, street or alley of the City or upon any property of another, except such property as may be provided and set aside for such use by the City, any tin cans, bottles, junk, trash or rubbish, or any waste matter of any kind or composition. The Council may enter into a contract for the collection and disposal of said material and may provide such rules for the regulation thereof as it is from time to time deemed best and necessary. SECTION 10. DUMPTNO TRASH ON PRIVATS PROY. No person shall dispose of or dump upon any private property within the City any tin cans, bottles, junk, trash or rubbish, or any waste matter of any kind or composition. SECTION 11, RECElTAOLLS FOR RUBBISH AND WASTE MATERIALS. Every person occupying or hating charge or control of any premises in the City shall provide suitable containers or receptacles for the acoumulation and collection of rubbish and waste material, each of which container or receptacle shall weigh not more than seventy-five (75) pounds when tilled and set out for collection. Branches of trees, hedges, etc., shall be out in lengths of not over four (4) feet and placed in containers or tied in bundles. Such persons shall cause the container* or r000ptacles to be emptied and all rubbish and waste material moved from the premises and disposed of in some lawful manner, such removal and disposal to be accomplished at least onto each calendar "4- week in the case of rubbish, and at least once each calendar month in the case of waste material, except as provided in Section 12. SECTION 12. HEAVY OBJECTS, DISPOSAL OF. Every person occupying or having charge or control of any premises in the City shall, at least once within each calendar month, collect and dispose of all waste material and debris such as discarded automobile bodies, and similar heavy or bulky objects, and all other material not included in the meaning of waste material as defined in Section 1, which may have accumulated on his premises; provided that building or construction waste or debris need be removed only upon completion of construction operations. All such waste and debris in this section defined shall be removed to such dump grounds as may be provided or designated by the City or County. SECTION 13. PENALTY FOR VIOLATION. Any person violating any of the previsions of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be punish- able by a fine of not mere than Three Hundred 0300.00) Dollars or by imprisonment in the City or County Jail for a peri3 d of not more six (6) months, or by both such fine and imprisonment. SECTION 14. ENACTMENT. This Ordinance shall take effect and be in full force thirty (30) days from and after its passage; and prior to the expiration of fifteen (15) days from the passage thereof, this Ordinance, together with the names of the members of the City Council voting for and against the same, shall be published once in the Costa Mesa Globe Herald, a newspaper printed in the City of Costa Mesa.
