HomeMy WebLinkAbout88 - Laying Out and Opening of Certain Public StreetsORDINANCE NO. 8$ AN CRDLNANCE DECLARING THE INTENTION OF TM CITY OF COSTA MESA TO ORDER THE LAiING OUT AND OPENING OF CERTAIN POBUC S`tRFETS IN THE CITY OF COSTA MESA, ORANGE COMUr, CALUMNIA, AND THE ACQUISITION OF LANDS NECESSARY OR CONYMM24T THEEtEFORE. WHEREAS there has heretofore been filed with the City Council of of the City of Costa Mesa, a petition signed by all of the owners of more than sixty -per -cent -(60%) in area of the property :included within the proposed assessment district hereinafter described requesting that proceedings be commenced for the laing, out and c?enin.,g of certain pu'alic streets to be known and designated as Virginia Place, Coil Place and Albert Place respectively, and that the acquisition of land necessary and convenient therefore in the City of Costa Mesa, California, pursuant to the Street Opening Act of 1903 (Division 6, Part 1, Streets and Highw.Vs Code) and expressly waiving the investigation Proceedings required by the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931"); NOW., THEREFORE, the City Council of the City of Costa Mesa does ordain as follove s SECTION 1. The City Council of the City of Co=tta Mesa hereby finde that all of the owners of more then sixty per cent (60%) in area of the property Included within the proposed assessment district hereinafter described have signed and filed with the City Clerk a petition for the improvement and a waiver of investigation proceedings under the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931". SECTION 2.. The public interest and convenience require,and the City Council hereby declares its intention to order the lMring out and opening of certain public streets in the City of Costa Mesa from Orange Avenue to Santa Ana Avenue, over and across the strips of ar►_d described in Section 3 hereof, said streets to be known and designated as Virginia Placc, Cecil Place and Albert Place, respectively, and to acquire ss3d lands by condemnation for said purpose. SECTION 3. The land necessary or convenient to be taken for the proposed improvement is described as follm,.s: (a) Land to be taken for Virginia Place (legal description): A portion of Lots 2939 2943, 303 and 304 of Newport Heights as shown on a map thereof, recorded in Miscellaneous Maps Book, page 83, Records of Orange County, California, being a strip of land fifty (50) feet in width lying twenty-five (25) feet on both sides of the following described line: Beginning at the most westerly corner of said Lot 303, said point beim in the southeasterly line of Orange Avenue, 60 feet In width; thence southeasterly along the southwester3y line of said Lots 303 and 304 and the southeasterly prolongation thereof to the northwesterly line of Santa Ana Avenae, 60 feet in width. -1- (a) continued...
